Just wanted to get your opinion on a matter that's kinda pissed me off. I've spent the last week attempting to get my MP3 player working at USB 2.0 - it's a creative zen micro 5gb and should work at 2.0 speeds no problem, but it only transfers at 1.1 speeds on my system and 2 other systems. I bought the MP3 player off of Craigslist from a local seller here in Sacramento, CA. Here's the post:

So, I contact the seller and tell him that he sold me a bunk player and he replies with this:
Hi Richard,
I am sorry to hear that the player is not connecting at USB 2.0 speeds. I did not myself know that it could transfer at that speed. So I did not have any problems.
As far as a refund goes, I do not have the facilities of a store, so I can not feasibly offer a refund. I expect those persons, shopping for particular items due their due diligence on this item to better understand its workings.
Here is a solution. Have you tried to contact Creative about the problem, they have an excellent web support system. That would surely be helpful, if not a windfall of information. I will try to locate the
receipt for the item. In my usage it has never given
me any problems. This is my word. I will help you out with anything you need. Just let me know.

Since then, we've had about 4 other e-mails, all in which he refuses a refund and keeps saying he'll look for the receipt. He also stated in his latest e-mail that it was an "as-is" sale, but there's nowhere on the post which says it's an "as-is" sale... I've exhausted all technical possibilities with the player and it's definitely a player problem. So, my questions:
1. What should I do in the event that he refuses to pay back my $$. Legally, do I have any backbone?
2. Do I have the right to a refund?
