What to do? Bought a MP3 player off Craigslist and it's not working properly??

Hey all,

Just wanted to get your opinion on a matter that's kinda pissed me off. I've spent the last week attempting to get my MP3 player working at USB 2.0 - it's a creative zen micro 5gb and should work at 2.0 speeds no problem, but it only transfers at 1.1 speeds on my system and 2 other systems. I bought the MP3 player off of Craigslist from a local seller here in Sacramento, CA. Here's the post:

So, I contact the seller and tell him that he sold me a bunk player and he replies with this:

As far as a refund goes, I do not have the facilities of a store, so I can not feasibly offer a refund. I expect those persons, shopping for particular items due their due diligence on this item to better understand its workings.

Here is a solution. Have you tried to contact Creative about the problem, they have an excellent web support system. That would surely be helpful, if not a windfall of information. I will try to locate the
receipt for the item. In my usage it has never given
me any problems. This is my word. I will help you out with anything you need. Just let me know.

Since then, we've had about 4 other e-mails, all in which he refuses a refund and keeps saying he'll look for the receipt. He also stated in his latest e-mail that it was an "as-is" sale, but there's nowhere on the post which says it's an "as-is" sale... I've exhausted all technical possibilities with the player and it's definitely a player problem. So, my questions:

1. What should I do in the event that he refuses to pay back my $$. Legally, do I have any backbone?
2. Do I have the right to a refund?

He's right, you're wrong.

He cut and pasted the specifications of the Zen Micro. Furthermore, he is correct, it is USB 2.0. You just don't understand what USB 2.0 entails.

USB 2.0 has two speeds, full speed and high speed. Full speed is coincedintally identical to the transfer rate of USB 1.1 (11Mbps). High speed is that 480Mbps.

As long as the product is the same as was advertised, and you don't claim that to be the case, it's your failure for not reading up on what USB 2.0 is.

Well, to me it is... I wanted to have a USB 2.0 player, not a 1.1. USB 1.1 sucks a$$.. I paid for a player that was supposed to be USB 2.0?

Ummmmm....i personally would not care....First, and formost...are using it on PCs that have USB2.0?

Also, if you buy stuff on criagslist, it is pretty much implied that it is As-Is.

Yep, OP shoulda done his research. USB 2.0 high-speed is the one you want.

EDIT: OP, I hope you send off a sorry email to the sender for causing so much hassle. It uses the USB 2.0 interface. IT IS USB 2.0. It just isn't the fast version. If you wanna complain, complain to creative for not using the better version of usb 2.0.

They are both USB 2.0. The USB forum made the specification that way so that everybody could advertise their products as USB 2.0. At any rate, it's still up to you to determine if a product meets your needs. He copied and pasted the specs page from Creative.com, I checked.

You're the one being unreasonable.

Does your PC support USB 2.0? If so, do you have the proper drivers installed?

I'm indeed using a PC that has USB 2.0 "high speed" and the MP3 player is "high speed" .. .I even went out and got a USB 2.0 card and tried it out on that with no luck just to make sure it wasn't my motherboard/drivers.

No, it's not. It's USB 2.0 full speed. You just assumed it was high speed.

K. I don't really get this. The MP3 player IS supposed to be USB 2.0 "high-speed".. I had one before I bought this player and it transferred at "high-speed".. but, this one doesn't...

Who cares? If you wanted one w/ the faster speeds, go to the store and tell them what you want. If it doesn't work, take it back...

Of course, you'll pay a higher price for the player at the store... You got a used player, and didn't know what you were buying... your fault.

No, it's not. It's USB 2.0 full speed. You just assumed it was high speed.

The player is supposed to be high-speed.. Check here.

I "knew" what I was buying.. and I "knew" it was supposed to be USB 2.0 "HIGH-SPEED".. but it turned out that it doesn't operate at "high-speed" due to a fault in the player... it's a hardware problem, as i've already upgraded the players firmware to 3 different versions and updated the drivers.

Then who's fault is it? Mine? I bought a player that was supposed to be USB 2.0 High-speed and it's not?

I have to disagree, if he says it works flawlessly then it should work...without flaws.

As stated before, craigs-list almost implies as-is.
Furthermore, have you tried his suggesting of calling creative?

edit: and have you tried any other USB 2.0 devices with your system?

So, you're telling me that you'd settle for USB 1.1 if you bought a player that was supposed to be USB 2.0 and it didn't operate at USB v2 specs?

Well, that sucks, but it was used and you decided to take the chance. Just tsell it for the price you bought it for and call it a day.
