The cop needs to prove by a preponderance of the evidence that he is guilty of what he is accused of. Innocent until proven guilty, not guilty until you can prove your innocence. This is the US we live in, didn't you get the memo?

theoretically, yes. in practical reality, not always the case. most judges ive been in front of assumed, and showed it, that i was guilty before i even had a say for my side. maybe its the human coefficient of cynicism that makes it that way, i dunno. they tgend to believe the cop, since they really have no real reason to lie over a guy that most likely is lying to get out of the consequences of his actions. i think its BS but it does happen.

I would be shocked to find it under reckless driving. Possible careless driving though. There is a huge difference. Reckless is mostly used for the much more dangerous things and it has a much steeper penalty. Careless driving is about as severe as a low level speeding ticket. For example, in a fender bender, the person at fault will often get hit with a careless driving ticket.

Of course, I didn't witness the incident so who knows...

Unfortunately for sake of expediency that concept had been pretty much thrown out the window for traffic offenses. Unless you can afford to pay a lawyer to come in and grill the cop correctly it is pretty much guilty as charged unless you get lucky when you go to court for traffic offenses.

Really? So I don't have to pay speeding ticket I got saturday night unless the cop has a picture of the radar with my car and the speed on it? Frikin awesome.

The cops word is considered evidence, so if thats all that is presented then good luck, but A little knowledge of the law can get you off the ticket though. If you ask him to prove the radar gun was serviced and able to be used, had no problems, etc, and he can't then you won your case. If 2 cops were in the car and 1 was holding the gun and the other wrote the ticket, and only one of them show up to court then you can also get off because both officers must appear to give you a fair trial... but you'd need to call them out on it.

I'm not a lawyer nor will I pretend to be one, but just accepting a ticket because a cop gave it to you isn't a very American thing for you to do 😛

I must have missed the part of the Constitution where it's unAmerican to accept responsibilty for your actions.

Actually, an engine is most efficient at wide-open-throttle (WOT). By and large, the gains in efficiency from WOT operation negate the losses from higher RPM from not short-shifting. The engine is most efficient at that point, but overall you still consume more fuel. Higher speed = higher drag = more fuel spent. Higher acceleration = more fuel spent. You do accelerate for less time, but now you've murdered your efficiency via more drag over the distance you travel. Even assuming significantly less efficiency at lower accelerations, to second order you will come out ahead in fuel economy overall. I took a thermodynamics course where we calculated the overall difference in fuel consumption between the exact cases we are describing now.

Run the simulation yourself, or hell, do it empirically, I don't care. If you're going to rely in theory, at least recognize that there's more to this than engine efficiency.

You've taken into account a second-order factor that boost fuel economy and ignored the dominating terms that significantly reduce fuel economy.

Wrong. It has been proven over and over again in studies. At WOT, an engine operates orders of magnitude more efficiently due to severe reduction in pumping losses that are otherwise caused by the restrictive throttle butterfly.

The absolute most efficient method for accelerating, from a fuel mileage point of view, is WOT combined with short-shifting. It has this is NOT based on the incorrect theory that "you're accelerating for less time so it's better", it's based on the absolute fact that an engine suffers severe inefficiencies due to pumping losses at small throttle openings, resulting in much of the engine's power being "wasted" to suck air past a restriction in the intake tract.

WOT acceleration combined with shifting at higher RPM has been proven, in actual practice, to show no significant difference in overall fuel economy when compared to light acceleration with moderate gear changes.

In all likelihood, your thermodynamics class made some assumptions in your calculations in order to make the problem simple to handle. IIRC, drag is an insignificant effect until 30 mph or so. (I can't remember the exact speed, but IIRC, it was at least 30mph)

His thermodynamics class also apparently assumed a diesel engine (no throttle butterfly). A gasoline engine is massively inefficient at small throttle openings from pumping losses. If we were talking about diesel engines, Eeezee would be correct, but we weren't.

On Cops that pretty much sums up a lot of what they do. They drive around and even say to the camera guy that they are using "tag light out" or a myriad of other reasons to stop a car and check it out. The bottom line from what I see is they can follow almost anyone and find a reason to stop them after a few minutes observation. And if they are willing to admit that with a camera on them I assume they can pretty much find a reason to pull anyone over.

You're so full of it, that it's not even funny. Cops DO watch for the tiniest infractions, and they do so regularly.

I'll accept the consequence of committing a crime, but not breaking a BS law because I failed to keep my acceleration rate under some arbitrary level. I'm not going to limit myself to getting up to 50mph in 20-30 seconds or whatever the hell it is.

I'm not a fan of taking off fast and I tend to get annoyed when I see people do it because they are usually the same people who tend to cut off others, tailgate a lot, and change lanes very rapidly just to get ahead of the "race". However, I am having difficulty understanding how accelerating beyond certain point from a red light while staying in your lane makes driving any more dangerous for anyone.

And if you had read and saw his sig you would know his car cannot do a burn out unless he turns off his active handling and traction control systems. Even if he floored it, he would not do a burn out with those systems working.

Haha, oh here it is, conclusive proof that accelerating at a quicker pace than other people on the road is dangerous.

Let me point out a couple things for you here, champ.

1: He's not going fast, he had wheel spin.
2: He was burning out, not "accelerating more quickly than normal", which is what I was talking about.
3: HE WAS RETARDED AND DIDN'T KNOW HOW TO CONTROL HIS CAR IN THE FIRST PLACE. </caps for brain-dead people who can't understand English>

PS, I've been ticketed twice for no reason. I fought both and won. Not really a big deal, but I'm just saying it so you can realize that your fucked up "absolute" vision on how cops operate is completely and utterly wrong.
