Cops/military don't get arrested for brandishing because part of thier job is that they may have to use lethal force at any time. That not your job JQP.

Logic flaw not found. Cops are exempt from many laws. That's why we do intensive background, psychological and credit checks on them to make sure they won't do stupid careless shit with gun they carry.

I doubt he had a 30 round clip though as those have been outlawed in many states.

First off its a magazine, not a clip. Secondly, very few states have magazine limits.

True, it is very few states, but New York is one of them, Commiefornia, Hawaii, Maryland, and New Jersey being the other four. It matters when it was made, and bought according to how I read the law, but as long as it's something that was available before the ban, it's hard to prove someone didn't own it before then.

Yep. Pre-ban mags sell for a pretty penny. Probably was better to invest in magazines in the early 90's than gold.

Its tough to back this guy. If you believe people are about to attack you at your house, you go inside, lock the doors, arm yourself to shoot if someone tries to come, and you call the police. But he goes inside grabs an AK-47 no less, lol and goes back outside and discharges a weapon that powerful. He doesn't call the cops but has his wife do it. Now there may have been a threat, but none that required him to discharge that gun at that point. From his story he should have went in the house, locked the doors and called the police. Its kinda hard to accuse thug gangs, but here you are discharging an AK-47.
 
I dont get when people say you dont have to aim with a shotgun. Yes, you do. Even with an 18" barrel, the spread on buckshot is so small at short range that you do have to aim.

Look at those groups at 12 feet, a normal cross-the-room distance. VERY tiny. Hell, look at their 20 yard test. At 60 feet you still see 9" groups. You must aim with buckshot or you will miss.

The point of a shotgun for home defense is the fact that you are less likely to kill your neighbors kid across the street with a stray bullet through dry wall, while still being highly effective on the intruder directly in front of you.

Don't know about 8 sheets, but a 12 gauge can blow the hinges off a door through the frame so I don't doubt it, maybe a .410 would be safer 😛

no way in hell i'd use a .410 for self defense unless it was slugs, then you might as well use a rifle.
 
An AK-47 isnt THAT powerful, it just fires a 7.62x39 intermediate cartridge.

I don't know a lot about guns, but the mystique of it being an AK-47 doesn't help his cause or paint a better image for him.
 
1) Aside from any legal technicalities that may exist in NY, I don't see a problem with warning shots.

2) Before saying he should have retreated into his house, I think we'd need to know what his house looked like. I live in a small house and every room has windows (some have quite a few), so there's no decent cover. And I really don't think you want to be near your wife and kid if you think there's any possibility of a shots. Why put them in the line of fire with you?

And as other's have said, if it was MS-13, these charges are the least of his worries.

The fact that I can go to any store that sells guns and buy a hunting rifle that's more powerful and accurate but doesn't have the scary "assault rifle" mystique is mind boggling.

I know, hence the 😛. I was shot twice with a .410 at pretty much point blank, didn't feel good, but I was able to chase the guy off, and then drive myself to call the ambulance.
