A neighbor interviewed said that when she went to call for help, the girl wandered off away from the accident scene and the neighbor couldn't find her when driving around the neighborhood looking.

If true, it seems clear she was likely high on something which helps explain accident, post-crash behavior, and threatening, erratic behavior at shooter's doorstep.

Using your methods I could accuse the homeowner of being drunk and on crack when the girl was shot. I don't do that because no evidence exists.

You've never been a first responder have you? Confusion after an accident is common due to a number of factors. Head trauma being a big one. Many people wander off. All the time. There's a reason we searched the area for additional victims at any major crash scene.

Everything you said is very narrow minded, yet entirely unsurprising, speculation.

You're right, saying she was probably high was speculation and I could be wrong.

I'm familiar with how people can be confused and disoriented after head trauma. But remember, something has to explain the initial car accident itself.

If you're hitting a parked car at 1:30am on the outskirts of Detroit, in a residential area... and then you're wandering off, and then two hours later you're apparently behaving in a way at someone's door that makes them think you're trying to break in... I don't think I'm out of line to think this all adds up to: you were probably on something.

But yea I could be wrong.

According to attorney Gerald Thurswell, McBride hit a parked car and "sustained bruises and lacerations" late Nov. 1 or early Nov. 2. Thurswell said that he spoke with people at a home near the scene of the accident who told him they came outside to help McBride and found her bleeding from the head.

"She kept telling them, 'I want to go home, I want to go home,'" he said.

Thurswell said that the neighbor went into her home to call 911, and when she came back outside and saw McBride was gone, got in her car to look for her - but couldn't track her down. Thurswell said McBride, whose cell phone was apparently dead, likely wandered the neighborhood for about an hour.

"She knocked on several doors and no one answered," said Thurswell.

The one man who did come to the door, apparently came armed with a shotgun. McBride was shot in the face and died on the man's front porch.

Even if the owner is going to claim SYG why not arrest while investigation is in progress? Owner has way to much time to sanitize the house. No evidence being gathered could effect any pending murder trial.

That sounds like a "oh shit, we're about to have a bunch of bad publicity for our department, charge him, charge him, now now now!" type of situation.

Seems like the actual facts of what went down don't really justify the cop being charged.

He hasn't been arrested due to the lack of probable cause that he violated the law.

If that is what really happened, this is murder. She was clearly hurt and you can't be afraid, but yet open the door and go outside. If she wasn't hostile toward the people helping her after the car accident, there is no reason to assume she became hostile towards this man either. It sounds like she sustained a concussion.

Well clearly that's not true and is over simplistic.

However, I agree with you that she may have had a concussion and that him blasting someone with a shotgun because they showed up at his door, and perhaps acted strangely, really cannot be justified.

Then again, the issue is complicated by the fact that he claims the gunshot was accidental.

Whole thing's a mess and a tragic one. In all likelihood, two people basically lost their lives for no reason.

Seems like had he been high the police would have noticed it when they arrived at his house and when he was at the police station for questioning. Police need probable cause to request a toxicology report.

I hypothesized earlier on in the thread that she probably was unconscious for those 2 hours that were unaccounted for. I was close, she wandered off after becoming confused after the crash.
