Time to move out of Mayberry!

BTW-Are you going to give us the details on the neighbor and why he/she would do something like this to you?

moving really is nto a option. with the price of houses dropping i doubt i would find anyone to buy it. as it is there are 3 houses for sale in town.

why would she do it? she is a bitch.

hell cops were called the other night because her son (named adam) who is 15 and 5'10" and maybe 230 lbs was threatning a 9 yr old kid. he was saying how he was going to kick his ass if the kid didnt give him a skateboard (that adam gave him him for his birthday over the summer) back. well fuck its in the yard and we have 2 foot of snow on it!

So, you're not going to tell us then?

Waggy's had quite a few posts about his neighbor issues.

Couldn't the be grounds for a slander lawsuit, or something similar? You need to figure out a way to work the law in your favor and get a restraining order - then the real fun will begin.

Well, I don't read every freaking post on here...nor do I remember them all either.

Reading through a couple that he linked to above though it doesn't sound as though he's been that easy to get along with either.

Get a lawyer. Doesn't matter if you don't know what s/he could possibly do, they'll know if there is something that can be done.

Here in CA, if you write an anonymous letter to the DMV and question someone's driving ability, (say they may have mental issues, such as dementia) sometimes they will make them come down to the DMV and do some tests.

DCFS?

Dept. of Children and Family Services.

I had pretty much gathered that from the context. I was more making a point that people should explain their random acronyms.

Wow, I was to infer that from your post?
I just inferred he was a dumbass.

With that out of the way, I am curious how much power DCFS really has. Quite frankly, without a warrant signed by a judge, I wouldn't let any government employee in my house or onto my property. I have no doubt that they have the power to come onto your property without one, but it's still unconstitutional.

DCFS has more power then people know. they will talk to the kids whenver/wherever they want. they can take the kids if they want.

if you don't couperate with them it will hurt you more then help. since then they will mark that as you are trying to hide something from them.

though they came on the worst day ever. last night we had a bunch of people over playing the wii adn PS3 until like 9pm. then early this morning both the wife and I had eye exams (woot new glasses!). so the house was a mess!

I applaud your self restraint. It would be very hard for me not to march over to the neighbor's house and threaten their lives.

I agree with other posters:

CALL A LAWYER ASAP

Obviously these "people" (I use the term loosely) will stoop to any level for any perceived wrong. You have to protect yourself and pursue any and all legal action against them to the fullest extent possible.

oh i want to go over and do that. but i know that would just get myself in trouble.

not sure what a lawyer would do.

restraining order.....

Where I lived a long time ago, we had racist neighbors who called DCFS on us when I was young. They called to check if our parents were home (When I was in grade school). Luckily, a friend covered for us. The racist neighbors moved away a year later. I bet stuff like this is common. You just don't hear much about it.

I have no doubt that's true, which only shows how pathetic the whole situation really is. There's a reason the government shouldn't presume guilt rather than innocence, and this is a perfect example.

She is obviously very aware that these hemroids are willing to escalate the situation to who knows what level and it's not worth the risk just to send them down to the dmv.

There's really not much a lawyer can do about this issue. As long as the law protects those who make the calls to CPS and other agencies, AND, as long as they're done anonymously...no trail can be established. One BAD thing about this, repeated anonymous calls tend to give them credence...and you'll be looked at much more closely, even if nothing wrong is found. It sux, but the system exists because of REAL problems...and ass-hats can and do abuse the system.

You may want to contact your family attorney, start documenting all the issues you're having with them, and include hard evidence like videos of their tresspasses and such...THEN, MAYBE you can get some kind of restraining order...MAYBE...

I think you're just in for a long, difficult time with shitty neighbors.

It was a subtle prod to the OP. Obviously you have no concept of subtlety, though.

I know exactly what you're going through, I forget how many times my wife's ex-mother-in-law called in bogus complaints about us.

Is there some kind of punishment for reporting a false claim?

No, no matter how many times the same person calls in false claims. At least not here.

Way to continue the threadcrap. I took the conversation to PM's to avoid that.

As for my feelings, I don't really care what you say as it has little to no effect on my life.

Now, if you'd like to continue this via PM, you are more than welcome to. This thread is not the place, though.

yeap. DCFS is set up to safe guard teh callers. so that they don't have to fear retalation. trouble is it is also set up to protect those that make fals claims.

Though if it is blatent and continues they can file charges against the person makeing the false claim. though its rare.

one big positive we have. We are fighting for custody of my wife's 16 yr old sister. Doing so we have already had a DCFS come talk to us and look over the house/finances etc.

Wow, that's a pretty good situation. I would think that the word of the DCFS agent would carry more weight than that of an anonymous caller.
