Woman Sues Over Ticket for Anti-Bush Bumper Sticker

Although a DeKalb judge threw out the ticket in April because the state's lewd decal law that formed the basis for the ticket was ruled unconstitutional in 1990, Grier is seeking damages for "emotional distress" against the county, according to the lawsuit.

Grier also seeks a declaration in federal court that her bumper sticker is considered protected speech under the First Amendment because she is "uncertain and insecure regarding her right to display her bumper sticker in DeKalb County," the lawsuit said.

The lawsuit was filed by the American Civil Liberties Union of Georgia.

Grier, a nurse who works at Emory University and other hospitals, also is seeking punitive damages against the DeKalb police officer who gave her the ticket because he "acted with reckless disregard" of her rights, the lawsuit said.

The state law prohibited lewd or profane stickers and decals on vehicles. A phone message to the office of DeKalb County CEO Vernon Jones was not immediately returned Monday.

Derrickson said Grier still has the anti-Bush bumper sticker on her car.

Seeking damages for emotional distress is moronic, although I think the declaration by a federal court would be fitting. As far as damages against the officer.....he should pay the price of the ticket.

Ticketing someone based on a law that was ruled unconstitutional 16 years ago really demonstrates what grade-A morons they really are. If the only thing the go-tards at the Dekalb County Sheriff's office seem to understand is a lawsuit with financial consequences, so be it.

You do realize that, in cases such as this, the woman would have had to have gone to the ACLU on her own. The only items that they truly go after w/o being approached are laws that are passed that are blatantly unconstitutional.

This right wing fallacial fear of the ACLU monitoring the entire country looking for reasons to sue is founded in about as much fact as a Bush claim of Iraq/al Qaida ties.

If the people of Georgia don't want to pay, they should make sure they have police who aren't idiots and/or bullies. After all, aren't conservatives always pushing for "personal responsibility"? Well here it is, you act like a jackass on a power trip, you get to pay for it. If your job involves serving a community, chances are good THEY will pay for it too...maybe next time they'll pick someone competent to serve them.

I'm about the last person in this country to support all the idiot lawsuits out there, but in this case I think it's a good object lesson, whether or not the woman actually felt any "pain and suffering". I realize you guys have a real hard time putting down the Bush-bong, but when you have a job like "police officer" it is NOT a platform for you to go around sticking it to the libs. What's sad is the inability for so many on the right to have any sense.

It's not complicated: if the speech is clearly protected, the police have no business ticketing someone for it, causing them inconvenience. That's harrassment.

Not everyone who gets a ticket dismissed is harrassed; there's an element of good faith on the part of the officer.

This case does not appear to me the 'good faith' standard and the officer should be disciplined, IMO.
 
So the cop was stupid and wrong first, and then he passed those qualities on to the woman so she can be stupid and wrong now too?

This is the same Dekalb County that locked me up for Distributed Computing as they said it cost 59 cents a second for 1/2 a floppy of data. They wanted me in jail for 125 years (7 Felony counts) and $815,000 in fines and restitution.

How is asserting her freedom of speech either stupid or wrong? How is taking him on and subjecting herself to possible public criticism from idiots who are ready and willing to put her down for doing so anything but couragous, especially when those same idiots don't know which side of the Constitution their own freedoms are on.

The cop's job is to know the law and to enforce it evenly and apart from his own political beliefs. If he cited her under a non-existant law because he didn't like her politics, he abused his authority. What alternative action would you recommend in response to such? If he is not disciplined in this case, should she (or we) wait until he shoots someone for the same reasons?
