I think they should appeal. The ruling was 2-1. Read the dissenting opinion, it boils down everything. After reading the dissent, for those that agree with the 4 suspension, tell me if you still think it is fair or rational.

But, as I said, he should appeal to the full appeals court (I believe he can do that), if not then appeal to the Supreme Court. Either way it'll be at least another year.

right.

I suspect it will be appealed. interesting because the suspension itself is based on BS.

hmm i'm still not sure this is a fight goodell should be pushing.
He can appeal all he wants. Brady impeded an investigation by destroying evidence which was what was argued a long time ago in this thread. You impede, you get fucked in the end whether you're innocent or guilty. Brady got rightfully fucked for not using his brain properly.

Judge Barrington D. Parker said the cellphone-destruction issue raised the stakes “from air in a football to compromising the integrity of a proceeding that the commissioner had convened. ... With all due respect, Mr. Brady's explanation of that made no sense whatsoever.”

and

... Circuit Judge Denny Chin even saying evidence of ball tampering was “compelling, if not overwhelming,” and there was evidence to support a finding that Brady “knew about it, consented to it, encouraged it.”

Technically, given we've finally moved beyond simple fanboyism in the courts, Goodell needs to follow through with this as far it goes. Why? This is now a fight between unions and employers. That in itself becomes a hot topic for the courts this year with what... two different major union-based supreme court decisions handed down this year so far.

Tell it to the judge, fanboy. Maybe you missed what he said:

"Judge Barrington D. Parker said the cellphone-destruction issue raised the stakes “from air in a football to compromising the integrity of a proceeding that the commissioner had convened. ... With all due respect, Mr. Brady's explanation of that made no sense whatsoever.”

Time to pay the piper Brady.

Oh yeah. i understand WHY he has to. I just think the negatives outweigh the pros of continuing it.

It's a fucked up situation. Brady didn't cheat and the NFL made a mistake. Goodell rushed to suspend brady without knowing science. BUT the nfl contract says goodell has ultimate say so brady gets suspended.

sad part is IF it was any other QB this wouldn't be a issue. SO many people would be on the QB's side the NFL would drop it. BUT so many hate him so they are willing to suspend him over a stupid issue.

it's amazing. Most people outside of NE think this is fucking insane.

Stephen A on how Brady should've just called Goodell and squashed it before all of this legal crap:
http://espn.go.com/video/clip?id=espn:15354102

ESPN Business Analyst Andrew Brandt on commissioner power precedent, and that while unlikely Brady could appeal to the entire 2nd Circuit or the US Supreme Court:
http://espn.go.com/video/clip?id=espn:15354242

ESPN Legal Analyst Roger Cossack on how the CBA gave Goodell these powers and he made the ruling that should stand. Also says "this is basically over" since "there is no reason for the U.S. Supreme court to take this case".
http://espn.go.com/video/clip?id=espn:15354321

Brady be kissing some ass and maybe they'll cut that suspension in half.

Stephen A said so therefore it must have been a real option.

Not a Pats fan at all but still think this whole thing is ridiculous. They had a whole season to prove the science and unless I've missed something I don't think they bothered.

they didn't need to. Since this ain't about rather or not brady cheated. It's about the fact that they gave goodell the power to do what he wants. He wants brady suspended 4 games.

This is all about a signed deal the players made with goodell.

won't happen. At this point goodell is all in or nothing. He has no choice. He reduces it to 2 games he just wasted a shit ton of money (though many think he already has).

Not exactly true. The judges looked at how Goodell came to that conclusion, like Brady destroying evidence and that factored into the decision as the judges said. If Goodell had said "Brady looked at me funny so I suspended him 8 games" that would obviously be ridiculous and not upheld despite Goodell's CBA power.

Goodell could have a change of heart if Brady came to him privately and apologized, who knows. Stranger things have happened. But I think it has to specifically be Brady and not Kraft. I do agree in the sense that both sides have probably gone past the point of burying the hatchet which should have been done a long time ago (like Stephen A said). Brady must be a true egomaniac if he couldn't even reach out to Roger to squash it. Fail on not only Brady but BB and Kraft for not bringing all sides together to resolve it privately. Now we will probably see more legal peens being whipped out to see who's bigger. It's Brady/NFLPA's move now. The 2nd and SCOTUS may not even decide to take the case as analysts are predicting (if Brady goes that route).

If Brady had no knowledge of any tampering with the balls, why would he bury the hatchet? If someone accuses you of cheating and then, in the absence of proof, suspends you for it, fuck that guy.

And, Brady cooperated with investigation as far as he was going to. Simply handing them his unlocked phone was not going to happen. It won't happen anywhere outside of the NFL either without a warrant. There is already legal (within the league) precedent for "tampering" (if it can even be called as such) and Goodell stepped outside that.

What is hilarious is that with how corrupt FIFA is, they still have a decent process and an outside arbiter for appears within leagues for shit like suspensions and such. Nearly all issues are handled in a timely manner and done within a reasonable mindset.

For what it's worth, I hope Brady is suspended for the tears of Patriot fans to flow. And, I hope the owners turn on Goodell. He is ruining their brand with his stupid shit. Literally, nobody gave a fuck about deflategate at this point, but he continues to fight it.

What in this verdict are you celebrating? 2 members of the court (whom I'm not even sure understood the case), basically said that those who hold the most power can negotiate unfair contracts, become judge, jury and executioner and we the little people have no recourse. Outside of you hating Brady and the Patriots, how in your life does this ruling help you?

I really hate the growing use of these type of contracts and arbitration agreements.

LOL! He had nothing to apologize for and an apology would be an admission of guilt. You're basically saying that he would have to admit to doing something he didn't do for the CHANCE of lessening his undeserved punishment.

Yeah. That makes perfect sense.

I personally know people who destroy their cellphone when they upgrade and they don't ask anyone for permission. Brady did and they OK'd it.

He's a public figure with an unrelated personal life he does not want leaked out from an old cellphone. Makes perfect sense and his careful, considered, and authorized actions are proof-positive that he was not hiding anything by doing so.

HE. ASKED. FIRST.
HE. GOT. PERMISSION.

These are not the actions of someone destroying something to hinder an investigation.

Brady is no dummy. Nor is his agent. He renegotiated his contract, again. The 4 games will cost him less than $300,000. That's a lot to you and me, but for an elite NFL quarterback it's an extended trip to Brazil with the wife and kids. Brady did this by having Kraft agree to change the contract extension to include a $28,000,000 signing bonus.

I guess Belichick will not trade Jimmy Garoppolo. as some writers have been speculating.

and

The phone destruction was AFTER he was told it was not needed. Brady also furnished a complete list of everyone he texted or Emailed and the NFL had already seized all of the Patriots phones so any relevant text or email would already be in their possession. I have never claimed "Brady knew nothing!" but what I have claimed was this should have been a $200K fine and done with. How can anyone rationally think the Pats or Brady were treated in a fair fashion right from the start?. How can the Vikings ball-boys be on camera heating up game-balls with a sideline bench warmer and the punishment be a verbal warning to cease the behavior. It would ( IMO) be a MUCH bigger advantage to be throwing a toasty-warm ball on a frigid 3 degree day then the supposed .3 PSI below 12.5. The fact that Brady's performance got BETTER in the 2nd half of that game speaks for itself, his play in the following SB speaks for itself. The NFL's handling was so abysmal that many who hated the Pat's were pulling for a win in court, "leaking" false data to Mort Anderson so ESPN could then make the Pats look bad, refusing to retract said information and issue a statement of the REAL ball PSI measurements. Then 2 days AFTER Goodell gets hammered in court we have ESPN publishing a 10,000 word "smear" campaign against the Pats from "unnamed sources" claiming dumpster-diving, serving warm Gatorade, accusations of bugging the opponents locker-room. If I were Kraft at this point I would seriously consider going full-on Al Davis if Goodell actually enforces the suspension.

most people that use common sense know that they did nothing wrong.

It's mostly those in the NE group that are against them.

personally i feel it's fucking terrible. IF they will do that to the strongest and most successful team then who's next?

One wonders why the NFPLA allowed the commissioner to arbitrate appeals, a moronic, huge mistake and now everyone will quit trying to challenge any punishment meted out in court as this case will now be cited as reference. I read the entire court ruling, in a nutshell it said to the NFLPA and the players "you created this monster, deal with it."

Who cares about the phone. I mean, really... The whole case was build on smoke and mirrors as we eventually found out. The only thing you need to consider is the ball measurements and method. Neither were sound, so the entire reason for the investigation was bull shit.

All that is fine and good, but for basis of case it doesn't really matter. It's all about whether the commissioner has the authority to do as he did.
