It is undeniable that when Biden gave the order that COVID was legally a national emergency. You can look it up yourself. The law clearly states that in cases of a national emergency the secretary has plenary authority to modify or waive loan requirements. It is the plain text and plain meaning of the law.

I fully agree. I never thought the judiciary's role is to carefully receive the need for law or the value to society or etc. It's most a matter of whether the law as implemented violates existing law or precedence.This is just emblematic of the larger problem of the major questions doctrine and why the court needs to be expanded until they abolish it.
As things stand now SCOTUS is a super legislature that vetoes any policies they politically disagree with. In oral arguments today conservatives were complaining that the action was unfair as it applied to some people and not others. Who gives a shit? It’s not their job to care of something is fair or not! There’s no ‘fair’ in the constitution.
This is why I'm not a fan of the forgiveness plan - student debt will just come back.
That being said, SCOTUS is still wildly out of line here. 'I think this policy is bad' is not a valid basis to strike something down but they've forgotten their place.
I don't know if they need to be 100% free for students for the first 4 years (having some nominal out-of-pocket cost to a student shouldn't be a big deal), but we do need to bring down costs. State colleges and universities need additional funding to both cut costs for students and allow for massive increases in enrollment. The latter can help put pricing pressure on private colleges and universities.
However, I also think that's a realitively distinct topic from the current student loan forgiveness plan and something that will require legislation to fix. I'm sure republicans will get right on that legislation part... any day now...

I think a good compromise would be for the government to subsidize it to the exact same percentage of costs as was done for the Boomers. Fair?It is subsidized in many ways through grants, loan guarantees, etc. What some want is for America to pay for your expensive college education whether you succeed or not.
