Sorry, but generic nudity isn't "child pornography" of any kind. And mere flashing isn't "sexual performance" either. For example, having a cute picture of your kids naked in the bath isn't illegal, because it isn't sexual in any way.*

since when is flashing a sexual performance? this guys life could be over and for what? cause some dumbass 15 year old flashes her tits and some guy takes a picture...wtf

That's a good point - shouldn't the officer himself be guilty of possessing child pornography, since his dash cam would have captured it?

As well as any store security camera that might be near by. At the rate we're going they can arrest half the town. 🙂

There is the letter of the law and the spirit of the law. The crime will be if the guy gets prosecuted IMHO. And, if he was just standing there would he still have been arrested for contributing to the delinquency of a minor?

What a joke. (As long as they don't look 12 that is...)

EDIT: But I think it would be fine for the cop to erase the pictures, or take his phone. But potential sex offender, no.

America is like 100 years behind the rest of the developed world in its attitude towards nudity and sex.

Unfortunately, there have been cases of people being arrested for having these types of photos developed.

I hope the state and Wal-Mart lose both suits and suffer staggering losses.

Obviously that won't happen, but you get the idea. The United States is full of fucking prudes. "OH SHIT, A BOOBIE." I can't believe with as advanced as our country is that we still treat sexuality as a crime. A lot of countries these days don't even bat an eye at a non-sexual depiction of a child. Hell, in the original Dragonball you see Goku's little 12 year old penis, multiple times.

I'm ranting now and I should stop because it gets me into trouble...

Is women going topless still illegal in America? I think we (Canada) had a court decision that put an end to that two decades ago.

If I recall correctly, women sued in NY & won. Women can walk around topless any time they want (in NY.) Besides the barely 70 degree day right now without high humidity, it's another reason NY is a great state. If it weren't for taxes, it would actually be a nice place to live.
