Pop-up ads get teacher 40 years in prison

Reminded me of the time it took me 5 minutes to shut down my browser after getting a continous loop of pop-up ads everytime I tried to close the browser.



"State Prosecutor David Smith said he wondered why Julie Amero didn't just pull the plug on her classroom computer.

The six-person jury Friday may have been wondering the same thing when they convicted Amero, 40, of Windham of four counts of risk of injury to a minor, or impairing the morals of a child. It took them less than two hours to decide the verdict. She faces a sentence of up to 40 years in prison.

Oct. 19, 2004, while substituting for a seventh-grade language class at Kelly Middle School, Amero claimed she could not control the graphic images appearing in an endless cycle on her computer.

"The pop-ups never went away," Amero testified. "They were continuous."

The Web sites, which police proved were accessed while Amero was in the classroom, were seen by as many as 10 minor students. Several of the students testified during the three-day trial in Norwich Superior Court to seeing images of naked men and women.

Computer expert W. Herbert Horner, testifying in Amero's defense, said he found spyware on the computer and an innocent hair styling Web site "that led to this pornographic loop that was out of control."

"If you try to get out of it, you're trapped," Horner said.

But Smith countered Horner's testimony with that of Norwich Police Detective Mark Lounsbury, a computer crimes investigator. On a projected image of the list of Web sites visited while Amero was working, Lounsbury pointed out several highlighted links.

"You have to physically click on it to get to those sites," Smith said. "I think the evidence is overwhelming that she did intend to access those Web sites."

Among the sites Amero visited were meetlovers.com and femalesexual.com, along with others with more graphic names.

Defense attorney John Cocheo moved for a mistrial shortly before closing arguments Friday, based on reports jurors had discussed the case while eating lunch at the Harp and Dragon. Each of the jurors denied the allegation under questioning by Judge Hillary Strackbein and the motion was denied.

Cocheo, who said he was surprised by the verdict, especially with the "contradictory evidence," said he planned to appeal. Amero had no visible reaction to the verdict, though her family was obviously upset.

Amero, because the charges are felonies, faces 40 years in prison at her March 2 sentencing. Her family, present in court for entire trial, declined comment about the verdict.

This was posted in P&N, but I'm curious to see the reaction here. I just don't understand how people can sleep at night for sentencing a lady to life in prison because children glanced and saw pictures of naked men and women that seemed like an accident.

Agreed, especially when a woman can have sex with children of roughly the same age and get 90 days.

Thats why PC's have a reset button or power switch ... she's certainly an idiot for accessing the sites in class, but unless she was showing the porn to the kids intentionally 40 years sounds just a tad harsh!

Or How about that hot teacher that had sex with her student and only got probation? Debbie Leferve or whatever her name was. My guess is, this teacher was a fat ugly woman. If she was hot, the juror would have let her off.

put the lonely schoolteacher away for life, but sentence the serial sex offenders to 6 months probation and community service. :disgust:

Yeah, the evidence must have been there that she meant to access the sites (that contain the pop-ups). But, I think the sentence is utterly ridiculous, a suspension is suffice, or even loss of credential. 40 years in prison? WTF is our justice system coming to? That sentence is reserved for murderers and rapists.

As the old saying goes, easier said than done. The teacher was undoubtedly shocked upon seeing it and probably doesn't have the sort of "turn off the computer so nobody sees the porn" sort of reflexes us guys have.

Can't say I'm surprised really. The "THINK OF THE CHILDREN, DEAR GOD THINK OF THE CHILDREN" crowd have just destroyed her life over a mistake. Sigh.

What got me in this case is the incompetency of the investigators, and the DAs for charging her with such charges. Some noobs trying to make a name for themselves?

Yep, it's funny how quick everyone here is to assume she did, and that she should have the knowledge to avoid spyware in the first place. Objectivity is a lost art :(

I don't know if evidence would have to be their, our courts (and the common populace) are full of such computer illiterate people that they may not even understand what spyware is, let alone that it could do such a thing. I've seen plenty of computers hit with spyware and the owners blame it on someone else deliberately accessing the porn.

Plus, it's possible a kid accessed the website, or that the teacher was going on websites that weren't explicitly porn sites, but ended up linking to them. It's been a while since I've seen a porn site full of endless loops though, don't both Firefox and IE come with popup blockers? Looks like some school system needs to turn on windows update.

She hasn't been sentenced yet, hopefully this 40 years doesn't happen. She could have raped every kid in the class and faced less time.

I can totally see someone getting flustered and embarrassed and trying to click like a madman to close the windows. Regardless, I agree with the above posters in that the max would be far to harsh. In practice, the outcome of other trials cannot (and should not) affect this trial. But even if her intent WAS to show them porn, I think that would be to long.

I work closely, VERY closely with digital investigations, and know that most investigators are not incompetence, and to convict they would have absolute evidence. They take great care in not only preserving, but uncovering the evidence and would know if a computer has been owned or not as it's the first thing they check for. If there are pop-ups, a quick glance at the history would determine the cause.

I definitely think that she was surfing the sites, and ended up getting owned in the process, just couldn't contain the pop-ups. Nontheless, I think the DA is a POS for slapping her with these charges, and the jury consisted of a buncha dumb asses.

absurd, utterly absurd. at worst, this women should have maybe received disciplinary action from the school - maybe a few days suspension, with loss of pay. there is no way this issue should be brought before court.

surfing porn web sites during school time is worht 40 years in jail? Simply absurd. The USA is perhaps one of the LEAST free countries in the world, it is a country where the moral majority use their political power to destroy the lives of ANYONE WITH A NORMAL SEX DRIVE.

Dude, I never said that she deserved the sentence. If you READ any of my posts in this thread, you'd know that I believe the worst she should get is fired. She never committed any crimes, and I think the idiotic DA is just going way overboard.

So you're safe from ever having your life destroyed in this country then? ;) I keed I keed.

The 40 years is a maximum penalty, all the way down to community service. Though this could be considered a sexual crime, with a minor.

Meh.

Typical media coverage on a court case. Continually states the maximum punishment of 40 years in prison. What the person actually receives may not be even remotely close.

If the person is guilty, then so be it, find them guilty. But wait for knowledge of what the actual sentance is before going off on how screwed up the legal system is.

Though I'm always saddened by how violence is so widely accepted, even in sight of children, yet it's when a nipple makes an appearance that hell finally breaks loose.

One more example of how utterly FVCKED the justice system is. I feel sorry for the woman... but at the same time, she should be smart enough to know not to look up porn on computers at school. My only sympathy for her is in the absurdity of the potential sentencing.
