The DA needs to charge the parents with child abuse and neglect. Maybe even vehicular manslaughter. Hell, they make WAY more sense than this suit.

I don't agree with their lawsuit, but you guys were really being dickwads for some of those guestbook entries. They lost a child, some of those entries went way over the line and were unbelievably childish. :|

I realize that, and saw an entry yesterday that linked to another board, but I'm pretty sure some fvckwads here were responsible for some of those entries.

I mentioned this story to my mother last night, and she related the following story:

My father used to own a lawn-equipment repair shop, and one of his customers owned a Torro rider. The guy was toolin' around his yard cutting grass, with his son riding on the back, on top of the rigid part of the clippings bagger. The kid fell off - Dad freaks out, somehow manages to kick the thing into reverse, backs up and hacks his kid to pieces. So he went and sued Torro :disgust:

I made an entry saying it was sad that such an innocent little girl was killed by her parent's own negligence and lack of common sense. And doubly-so now that they were trying to make money and shift the blame on the deal.

But yeah, the ones that said the little girl was ugly and such were a bit much, but everyone's a badass on the internet, I guess.

Why not? Given precedents which have already been set, the murderers are set to win tens or even hundreds of millions. They're probably stupid rubes who can be bought off for a few hundred thousand or a couple mill, I think Nissan will definitely go that path.

Actually, that lawsuit was not exactly frivilous. McDonalds was at fault and was generally being a huge dick about the whole thing. She only sued for the cost of her medical bills, but the jury awarded her like 10x the amount as punishment for McDonald's negligence.

I just want to officially say I did not post that. True, as I posted earlier, I think the death wasn't necessarily an accident, but I wouldn't taunt the parents like that. That crosses far too many lines.

SUVs, like any other large vehicle, have increased dangers. Its not just the blind spot behind the vehicle, it?s the blind spots in the rear corners. These blind spots are made worse when people install lift kits on their vehicles. Some of the largest SUVs can not see compact cars that have been lowered when driving parallel to said SUV.

I have personally seen SUVs pull into adjacent lanes when a small car was already there.

I have personally seen SUVs tip over when cornering too hard.

I have a friend who was rear ended by an SUV that couldn't stop due to its weight in a situation where a car would have.

I have dings in my door because the SUV owner in the spot next to me can barely fit into his stall. Given that I telecommute and rarely drive, and that the paint chips match his SUV's color, it's safe to say that he caused the dings.

SUVs are just as safe as any other car when driven by someone trained to drive vehicles of that class. Most US drivers are not specifically trained to handle a SUV. Most US drivers never receive refresher courses in how to safely drive a SUV. Most US drivers suck at driving to begin with, making them even more dangerous behind the wheel of a SUV.

As such, I stand by my claim above.

What a load of crap. Its a two way street. You can't just say SUVs cause all that stuff.

I have an SUV and I got rear ended this past weekend by an Audi TT. Too bad their car got fvcked and mine just had a scratch. I've been cut off by cars on the roads just as much as SUVs because the drivers were not paying attention. I have dings on my doors too. Maybe they are from SUVs maybe they are from cars. Maybe we should ban 2 door cars too or make their door swing upwards because the doors open much wider than SUV doors and cause dents?

What about all the aggressive drivers driving fast cars? Aren't they dangerous as well? I've seen more of my share of sports cars or riced cars that have wiped out on the roads. Should we ban them too? I would say a sports car going 100mph is just as dangerous as an SUV going 65mph.

Gunslinger is right one this one (contrary to popular belief)...Coffee that accidentally gets spilled on you should not cause 3rd degree burns on your body. When she tried to tell that to Mcdonalds, they blew her off which then prompted the lawsuit...IIRC they were keeping the coffee 20 degrees hotter than most other places (like around 160 degress or so)...

This lady didn'tjust spill coffee on herself and then sue MD out of the blue...

I'd guess these parents are doing every thing they can to convince themselves and their consciences that they aren't responsible for the death of their daughter. They sort of need to come to terms with the fact they are responsible for their daughter's death.

Case facts

In short, here are some quick facts:

- The woman, Stella Liebeck, was *not* driving the car at the time
(The car was not even in motion at the time of the spill)
- Lieback received 3rd degree burns on 6% of her body
(check out the conditions for 3rd degree burns - they are pretty gruesome)
- Lieback was hospitalized for 8 days
- Lieback received numerous skin grafts
- Lieback tried to settle for $20,000 (McDonald's refused)
- McDonald's had 700 reported incidents of burns (some just as severe)
- A manager testified that the coffee was "not fit for consumption" at the temperature it was served
- Liquids at 180 degrees cause 3rd degree burns in 2-7 seconds.
- Liquids at 155 degrees are exponentially less damaging
- Lieback was awarded $160,000 in compensatory damages
- Lieback was awarded $480,000 in punitive damages

In short, this was not a typical, frivolous lawsuit. It was a valid case against a company that willfully sold a product to a customer that was unnecessarily dangerous, despite numerous previous complaints.

I'm all agianst frivolous lawsuits, but I'm also for companies to take responsibilities for their actions, as well as individuals. Serving a "drinkable" beverage that melts skin and flesh upon contact is patently stupid.
