Can they take your home for pot possession? Not usually, I wouldn't think. It's a misdemeanor in most places. Now, possession of a prescription drug without a prescription, and selling dope, I would think they could easily seize your house, if they wanted to.

Something else... Are you the only owner of record on the title of the house or is anyone else on the title with you? If you have a second person on the title, say your mother, and she is not in agreement with you to evicting your sister then you are screwed.

And I am not suggesting you call the cops on your sister or try to get them involved. I just think it would be wise for you to go talk to one, without it being a crisis situation, and they could fill you in on what they can/will be able to do for you should a situation come up. You need to get yourself informed and gain the upper hand here.

Well considering drugs have been being sold from that house consistantly, I would bet Yes, they could seize it.

Some drugs are sold here I think. Its more of a storage place for less than a pound of weed and pill that are perscribed to her.

What kind of ghetto do you live in? Your family is selling/abusing drugs, your gf's DAD abuses drugs. Geez. You should run away and not look back.

legally you cant kick them out...you have to have them evicted. Since you are on SS the court fee can be waived. I think it takes like a week or so but dont say anything to them about it. Social services will come to the house with the papers and give them 3 days to move out.

I forgot if it said so, but, how long has this been happening? IIRC from some law class I was in, in grade 9, if this has been going on for a while, it may be thought that you condone these activities. My advice would be to contact a lawyer, ask him/her about your options, and if you could be possibly fvcked over, don't involve the cops and just evict them.

That?s one of the reasons the cops aren?t an option. I?m working on kicking them out. I gave them there 2nd warning and now they are going to getting out if anything else happens, which something will. I have to do things the way my mom wants it done, fair and loving. She pays for me and has been while I've been sick, i respect her wishes and will do what she wants to the best of my ability. I had endocarditis, which was caused by a stomach problem I have. Basically i went from making 90,000 a year to not knowing where my next meal is coming from. My mom and my sister both have me by the balls, it sucks, but by condition has me depending on other people right now. My sister is just another example of some one taking advantage of another?s misfortune.

Oh and thanks allot to all of those people calling me a Idiot for not incriminating myself by calling the cops. That's really productive. If you think life?s decisions are as easy as making one decision regardless of the outcome, then you have not made very many life changing decisions. Living in a ghetto in poverty most of our lives with a family of 8 you have to make allot of decisions regarding drugs, cops and money. And they are not as easy as changing groomers for Duffy, because the last groomer botched her poodle perm. This is my family, I love and can't stand my sister, and it?s a tuff position to be in. I'm not the type of person who gets walked all over. I'm giving her a chance to straighten herself and her kid up or ship out. If she can deal with it that?s great, if she doesn't, which is the most likely, she hits the curb. I'm dealing with the problem and not being walked all over. As far as the violence goes I'm 6'4" 200 lbs when healthy (now im 150 while sick) I've taken there best shot and not even noticed. I'm not standing for any more violence, next incident, whether selling sh1t out my house, hitting anyone, or blatant disrespect they are gone.

Cop out? Call 911, evict them, and boom that?s it. Pissing my mom off, throwing away the help i need from her, isn't a big deal, and possibly loosing my house to foreclosure isn?t a big deal either. I'm kicking them out, I just have to do it a certain way, or I will be forfeiting everything I own and winding up sick and in the street.

Does your sister rent from you under a formal agreement (a lease that you both signed)?

I'm not sure that she has many rights as a tenant if you basically "rent" to her under a verbal agreement. You should not be constrained by any landlord/tenant relationship so far as having her removed from the house.

But of course, research the laws in your own state.

How did you last this long with the frequent attacks without viciously assualting the son?

I'm not sure what the policies are against self-defense when the person is only considered a minor and you're a lot greater than them in size, but I don't think I would have had the self control to not at least land a blow or two.

You have more self discipline than I, thats probably worth some respect even if you're not exactly handling the situation the way it should be. You need to call the cops regardless of the rent problem. I'd rather be evicted and have a bad credit history then end up in jail for some sh!t these assholes will try to spin around and pin on you; its obvious those people, despite being family, don't give a sh!t about you or your/their futures.
