on it's face they may or may not be
they might both file single, both live in the same house, he can make a ton of money and she can claim no income but 2 dependents.
they MAY be committing fraud if they in turn declare themselves married for the purpose of whatever benefit.
a similar situation would be if they were long term bf/gf, she claims 2 kids no income and he makes all the money. the law wouldn't be broken and people would just assume they were in a LT relationship.
