I seriously doubt that they're being honest when filling out any forms. So wouldn't it be illegal to lie to the government? Isn't that fraud?

If they're being dishonest when filling out forms, then they are certainly breaking the law. But if they are not "married" so to speak, and file taxes seperately, how is it illegal?

they probably work "off the books" , gray or black market "cash" jobs or self employed that don't do their accounting so they don't report income correctly


they'll end up in FPMITAP when the IRS catches them

My wife and I took the time to report a couple who was doing similar. They were both working under table and making good money at a food distributing company. They had a car and a small townhouse and 2 children. They were getting state sponsored medical assistance from the govt designed for low income persons. Their income combined I would say was at least 50 or 60K. Not only that...

Both of them were on visas and they paid a company a large some of money to sponsor their H1-B visa into a green card. Unfortunatley you have to work at the company of course to do this.

I contacted and reported them and even had inside information about them to the appropriate authorities (I.E. USCIS, IRS, and State regulators fraud hotline). But that was 3 years ago and absolutley nothing happened.

so if he makes $50,000 in cash each year, if you look at his tax returns he probably reports $10,000 income and gets a EIC bonus check from the IRS each year (ok , it is really YOUR money he is stealing)

I'm not that up to speed on the entire process, but I'm pretty sure it involves household income. If you live with parents, or in this case a spouse, then their assets and income get lumped together so that they are disqualified. This person probably rented an apartment or holed up in a vacant place long enough for the welfare people to complete their checks, then moved back. Just think about why students living at home can't get welfare... not the same situation, but there rules in place.

Aren't they required to report *together*, since they live together and have children together? I know that "marriage" is the key word here... but I think they may still be required to file together since they are a permanent couple.

They would only have to file together if they are married.

Even if they are married they don't have to file together. They can file separate.
They will have to list that they are married though.

(My wife and I filed separate a couple years ago because it saved us a bunch of money - long story)
