I'd put those things up for free on craigslist the minute I saw them. It's an Atlanta suburb, someone will come and get them.

This story makes me rage. The homeowner is a TOTAL pushover. That's probably why he's getting kicked around.

That is a great thread. I read it again for the lulz.

It's especially funny when the dude get their contract... and finds they are in breach of it.

Edit: Last I heard they were trying to get him to pay them $5,000.

After they became aware of the thread they took me to court for slander, drummed up false E-mails claiming: "I'm going to #@$ chop your arms off.......","I'm going to shoot you in the face." And even stooped so low included, "I'm in fear of the lives of my 3 little girls and up till 3a.m. worried my house will be burnt down!" WOW! (He included that in the entail judgement against me to the judge). My jaw dropped, I informed the justice they could have full access to my ISP (Internet Service Provider), provided phone records, and offered to produce my PC to show I had not sent e-mails or contact. Also claiming I was running an apparel clothing line: CHECK IT OUT:

They secured a Gag Order which prevented me from electronic interaction with the public (included text messaging).

A week later I was delivered a Notice To Comply from the law firm in the order of $5,000 to be paid in full with in 10 days. WOW! The balls Hun?

If the full sum of $5,000 is not paid in full, further litigation would take place.

Needless to say 10 days came and gone......then the mail started to come! It was repeated Justice Court Proceedings and attempted judgements against me, PRECURSOR to my acknowledgement, stating EVEN MORE false accusations "...he continues to run the Internet thread...", ".......he continues to harass us..." "...he's in continuous contact with us and in contempt of court.."

Looks like they tried at least 5 more court actions then finally -

I was dumbfounded the judge ruled against them

I exercised my freedom of speech, did not exaggerate, made no threats, broke no laws and attempted to use more of a journalistic approach to the story so they can forget slander.

Since, and do not know whether this is directly due to: The Disney Land sized community has been re black topped with more Guest and restructured parking. The Gag ended quite some time ago, their presence has been reduced, there has been no interaction, and there has been a significant reduction in boots.

In all, I thank The Car Lounge so much for their overwhelming support! Thanx a million and if your ever in the Phoenix area look me up! Thanks for everything guys! And remember, if you feel
wronged stand up and don't take it, but do it right! Be sure to keep it real in the posts, take a breather before you keystroke!

It goes both ways. My HOA doesn't enforce things enough, in my opinion. For example, we have a neighbor who goes all out for Christmas -- he has lights and dozens of props in his yard, such as deer, etc. The problem is that the last 2 years, he literally has not put the stuff away until the middle of March. It looks stupid and trashy to see Christmas decorations out in the middle of March. I reported it to the HOA and they actually said "There is nothing we can do." Seriously? You couldn't have at least said "Hey, we've had complaints about your decorations being out 2+ months after the holiday ends -- can you put them away?"

The funny thing is if the HOA idiots drive this guy into foreclosure with all their ridiculous fees and assessments they will end up with nothing.

If there is nothing in the bylaws then they might be right. There is nothing they can do. I would much rather have an HOA that recognizes their limitations of power.

Did anyone else notice in the OP on the other site the guy mentioned that they were thousands of dollars behind in their assessments, and owed $3k in lawyers fees to the HOA? It's clear that there is some major HOA ridiculousness going on but it's pretty obvious that the OP isn't a complete angel either.

HOAs suck, but if you don't like it don't buy in to one (or at least not into one that's so crazy). If the guy either paid the HOA fees or chose not to live in a place with ridiculously high assessments this wouldn't be an issue.

Did you see what it was over? it was something like $3000 in attorney fees in a very short period of time. WTF? That is just insane considering his neighbors are likely splitting the bill as well.

This sounds liek a lawyer for the HOA just trying to provide services in order to make money, and not doing what is best for the HOA. Pathetic. And why would a lawyer be invovled in anything done (as it seems)? The peopel running the HOA are morons.

I didn't read the whole thread in the OP but did see a post where he said it all started with some special assessment for $1,000.00 that he paid them $500.00, then another $500.00 a few weeks later and due to that they then hit him with $800.00 in attorney fees followed by another $1,500.00 assessment. The whole thing sounds crazy to me, must be some type of condo association for them to be coming up with special assessments for amounts like that.

I understand that, but they could at least say to the guy "Hey, we'd appreciate it if you would pick that stuff up. We've had some complaints." No need to threaten or anything of that nature -- just a friendly request.

Last summer, people were getting pissed because neighbors weren't keeping their lawns up in the dry, hot summer and the HOA wouldn't do anything about it. People started mailing letters to their neighbors and impersonated the HOA. :D (no, I was not one who did that :) ). We found out because the HOA mentioned it in the monthly flyer.

When the crap is blowing all over the yard, knocked down, and otherwise looks like crap, I do care. It is an eyesore. Sorry, but if you have enough energy to put tons of decorations in your yard, you'd better have enough energy to clean it up in a timely manner. If you're too lazy to take them down until 2 or 3 months later, don't put them up. It isn't hard. I'm not saying they have to be down by 12/26, but I don't think it is unreasonable to say they should be taken down by the end of January. The guy has a wife and 2 kids and if they all got out there, they could have everything taken down in a few hours.

I think it is unreasonable to micromanage what people do on their own property. Yeah you and I might not like it, but then, it's their property, so...

The real question is, why couldn't you talk to them about it without the HOA to hide behind?

Sorry, but I don't think it is unreasonable to request that your neighbor regularly mows his/her lawn and puts up their decorations in a timely manner.
