A) It's generally illegal to block an ingress/egress from property
B) The HOA's personal property is now on the guy's real property. Send the HOA a notice that they have 24 hours to remove their personal property. If they fail to do so, hire a company to remove said personal property and dispose of it, and send the bill to the HOA. Sue the HOA when they refuse to pay.
 
This should do it, 1 ton engine hoist.

If they fail to do so, hire a company to remove said personal property and dispose of it, and send the bill to the HOA. Sue the HOA when they refuse to pay.

even if they do they cannot block the homeowner in i would think, could be viewed as a safety hazard, if they had to rush to the hospital for instance

Yeah, I would think if something happen, that the HOA would be putting itself in a position to be sued. I say if he killed the hoa president and I was on the jury, i'd find him not guilty.
 
I'd put those things up for free on craigslist the minute I saw them. It's an Atlanta suburb, someone will come and get them.

This story makes me rage. The homeowner is a TOTAL pushover. That's probably why he's getting kicked around.
 
Story irritates me. My HOA is a piece of shit also. The only way I can get those idiots to actually return a phone call is to submit a BBB complaint.

You're upset that they don't have an online payment system? Seriously?

For the HOA to take online payments 1 of 2 things will have to happen:
1. They try to do it themselves (not likely) and end up with an insecure and problematic system. They also will have to pay a percentage of each payment to the card issuer.
2. They use a service provided by another company. There will likely be an upfront cost and a per transaction cost, on top of any charges by the card issuer.

Sorry, but sometime you've got to leave your house, mail something, or even just do a bill pay through your bank's website. It's not that big of a deal.

I would take home one of my tactical vehicles with a winch on the front, probably one of my M1117 Armored Security Vehicles. I'd use the winch to pull all three of those blocks down the fucking street and drop them on the HOA President's lawn or maybe front door step.

I don't see how ANYONE can not have a problem with this.

Someone needs to start a class action lawsuit against all HOAs so that they can be deemed illegal and disbanded.
 
HOA's can be a good thing if done properly, problem is they almost never are.

Not that I'm a huge fan of them....but when would you ever hear about the ones that are good? What's a person going to say? "Boy! So glad my dues are being properly spent on maintenance services and improvements for the common areas! :awe:"

The only people that think HOA's are good are the nosy people that are in everybody's business. Oh let me take a picture of your back yard. Let me measure the height of your grass.
 
I was suppose to have an HOA-relate trial this morning, but it got postponed.

I have another case that is entirely about a homeowner wanting to feed wild squirrels.

You guys do not know the half of it when it comes to HOAs. (And, BTW, it is not always the HOA Board running wild. There are plenty of crazy owners out there, too.)

This is true. There'd be a tiny fee to process the payments, but its not like they're actually do anything with those dues to begin with.

I noticed that you didn't comment on their lack of website though. 😛 That would be extremely inexpensive to create&operate. Could easily add contact information, notes from the monthly meetings, a forum for the community members, etc. Right now, the only thing I get from them is a quarterly newsletter, a single sheet of paper, with some generic information, and a new booklet of stubs to mail them a check once a year.
 
I hate you, I read the entire story only to have it just STOP. can't seem to find out what happened, as there was no conclusion, maybe they killed him? HAHAHAH
I assume that they "settled" to some extent and as a result he can't share anything more online about the situation. There was some threatening stuff down on that other website (apssucks.com or something) and used that as leverage to prevent him from sharing anything else. He didn't say anything wrong himself (except maybe when he gave the guy's info out), but he did tell the story in a very douchebagery way. I'm sure he could win if he had money for a lawyer, but it wouldn't be worth that.

Also, the story seemed to have reached a conclusion in some ways. APS went wayyyy overboard to try to get back at him but they really couldn't get anything on him. They ended up pissing off the entire community which only makes the damage worse for them. They could have been sued for breach of contract or at the least, that HOA and others serviced by APS, could not renew the contract when the time came. I think at this point APS would be willing to suck it up and drop all fees if the guy would stop posting about it on the internet.

This, I was expecting the blocks to be on the road that I'm sure is in the HOA trust. Putting it on the guy's driveway is pretty stupid imo.
