Two good points. I'll add a third: It's entirely possible that Pagliano broke the law at the direction of Hillary, and if so, it's a lot more likely that he is indicted than that the Democrat nominee is indicted. Pleading the Fifth and having everyone assume he's guilty (or covering for the Hildabeast) is smart compared to the possibility of being indicted for something, correctly or not. He has every reason to not cooperate. For the DoJ, they need to wrap up this investigation well before the convention and the D-R debates, so Hillary can say she was completely vindicated. And knowing that whatever Pagliano did was at the direction of Mrs. Clinton, granting him immunity makes just as much sense (from their standpoint) regardless of whether they are trying to get bigger fish (i.e. Mrs. Clinton) or simply trying to make this go away. Pagliano was simply a tool, and there's not much point in indicting tools.
