No, no, not breaking and entering. Just tell her you're coming over to pick it up. Just as if I lent you a CD a while ago, and said I'd stop over tonight to pick it up. You're not suggesting you're going to fight her for it. Assume she'll hand it over willingly unless told otherwise.

"Hey, Mary, I know we talked about that PC I lent you, and I need to pick it up tonight. Would 7 or 8 be better for you?"

If you do have to pursue legal action, it would look good for you that you tried to get it back. The way it is now she could say she fully intended to return it but she kept forgetting.

For material Items, you don't sue for current value unless current value is higher than paid value. If you paid $2800 that's what you go for. If you have a reciept with serial numbers then you are golden, if you don't then you might be screwed, but if it has let say, Un-licensed software, all you do is report her to the companies of that software.

Pull out the IDE cable. Have her troubleshoot, and see if she'll give it back, or pay to fix it. If she pays, try taking out the video card, etc.

If he can pull out the IDE cable, he has access to the computer and can take it home. She's preventing him from having access to it.

So she initally agreed to let you have it back. That tells me she's not going to fight to the death about it. Tell her you are coming to pick it up, ask her if 7 or 8 is better. If she balks, just say you'll be over at 8 to pick it up. Make sure she sees you are dead serious.

Show up at 8 and if she gives you a hard time, call the police right there from your cell. Let her know that's what you're doing. I think the odds are very good she'll cave in and give it back on the spot.

she may be trying to claim the computer because of

if you don't get help from the police, you can sue for
a.) injunctive relief - the court forcing her to give the pc back to you

b.) damages - the cost of the pc
you must be able to prove that the pc is yours; receipts / serials (to software and the hardware) will be your best bet. further evidence that shows you lent it to her, rather than gave it or donated it, would be useful.

Sounds like a law school answer :)
