I wouldn't say for sure all cops will do nothing, some will take it seriously while others won't be very helpful. How busy the police are in the area, how they typically handle threats at this stage, what kind of mood the guy at the desk is in, etc all makes a difference!

It's all relative. If you don't call the police and he does do something. They will say why didn't you call the police?

And, it's quite possible, depending on where you live, that if you do call them they will blow it off as yet another threatening email of which there are millions every day.

But, you should still call. That's what they are there for. They might help or if they don't you will at least have proof you did.

Hopefully, the police in your area will care and treat the email seriously... those "connections" seem interesting.

From the sentencing guidelines: (c) For a felony of the second degree, by a term of imprisonment not exceeding 15 years.

I would refuse to do anymore work for this assho!e on general principle.

Report the threat to the police, and have them issue you a case number. Get the name of the officer to took the report. Report any further threats to them immediately, and without delay. Let your neighbors know about the threat - they can be useful as witnesses if anyone suspicious tampers with your house/car. Buy some disposable cameras, have them and a cordless phone handy just in case.

My opinion is that this guy is trying to strong-arm you into throwing in some extra work and/or a concession on the price. In your position I might have been willing to work something out had he been civil about it - but after his threatening letter - all bets are off. If the police get involved, this guy will complain that you didn't follow through on your computer work to try to put you in a difficult position. My reply would be that I was perfectly willing to work with him before receiving his threat. It is a result of his action (the threat) - and not yours - that makes any further work for him impossible.

Sorry to hear about your problem. This is another reason why mixing family/friends and business is a bad idea.

You know whats ironic... all this time they could have just pay someone to fix the damn computer... supposedly... they couldn't RMA the stuff because his girlfriend would need the computer a week ago or some crap... uh huh... well a week ago passed already. Geez... that guy is an idiot.

The reason I say to go ahead with charges is that I had a former employee threaten me one time. All he had to say was, "Why don't you come out here so I can beat your ass!" and just as I started to loosen my tie and go out there to whoop his ass myself, I realized losing my job wasn't worth it and being charged with assault as an Army Reserve MP wouldn't further my career too much either. I called the police, filed a report and went to see his ass in court a month or so later. He plead down easily because I had no witnesses to refute my claim, but he still got 6 months probation for it.

He's not for the fixing, he's trying to show he's a tough guy and also get a free replacement without costing him anything out of Aphex.

Aphex shouldn't have to do anything for them. He threatened him, he doesn't need to do anything nice for Garry. He'd be giving in to his demands that way. In the last thread, Aphex described himself as busy... so I doubt he'd have the time to do that.

Do not call him back with any threats or smartass remarks. That can be considered "escalation" and you may lose whatever footing you currently have.

As mentioned, take the email to the police ... at the very least seek advice from the cops. If you have or know a lawyer, talk to the lawyer. Each state has different laws, many cities also have ordanances. Get the information from someone that knows the laws for your area.

Whether you provide a written warranty or not, there are usually some basic warranties assumed by most states and communities. There's usually a "Warranty of Fitness" or "Mercantability" (something like that) ... basically that you are selling the unit with the presumption that it works (unless stated otherwise, or is sold "as-is"). If you took money as payment (not just to offset costs or pay for the raw materials) you became a "professional" and / or a merchant ... other commercial law may apply.

And, of course, you DID declare that fee on your income tax, right?


Talk to the cops and / or a lawyer in your area. This could be more complicated than it looks on the surface.

300 miles away... despite his invoice saying that he holds no responsibility for fixing anything that breaks... and he got a measly $20... so now he has to go bend over for this guy again... man that would piss me off and i would be the one threatening that dumb sh*t.

Forward it to the police, let him know that you did.

File a restraining order against the guy as soon as possible. They aren't expensive.

Buy a gun, shoot on sight.

A. Tell them that any future contact with you need to be through your lawyer. You will not answer any more questions without them doing so.
B. When they ask who your lawyer is, refer them to point #A.

Seriously, call the cops, get a restraining order; most others have already said what you should do.

He says he has friends in low places? Correct me if I am wrong, but the right term is "High places", which means that I have good connections with people in law enforcement and the mafia. Low places would means someone like a wanna be thug.
