Read what I said in reply to notfred's post. If she has a problem with it when sober, then yes. If she doesn't, then no.I would say OMG no you invited me here.
Now what about the first situation? Is it rape?

Either that or Drexel forced the freshman body to attend an assembly on date rate, given by a sex ed professor from a major university in Richmond. I guess he probably doesn't know though, right?? It is rape, they even showed us court cases of that EXACT thing happening, and guess what? The guy was convicted. Don't tell me what I'm saying is bullsh!t when you don't know what's going on.Ok, that's bullsh!t. It is not rape anytime a girl has had anything to drink. In this case where she was half-unconscious there's a problem but women generally can have a few drinks and still know what they're doing.
You must either be very young or have no experience with alcohol.
So if go out on a date with a girl to a clun and have two drinks, later she invites me over to her house to get it on and then makes breakfast in the morning I RAPED HER?!?!?!?
I say BULLSH!T.
Same situation, have a few drinks, but in the morning she says "OMG you raped me", it IS rape. Your sorry ass is in jail. Have fun with that!
I would say OMG no you invited me here.

The point is, the cops would still arrest you and you would be prosecuted. The burden of proof then falls on your shoulders to prove that you did not rape the woman.

I dont want to say too much but, my friend was not that wasted because we only had around 3 or beers each.
Anyway i just wanted someone elses insight into this matter, since its been naggin me since last weekend.
what's important is is the girl filing charges against that guy? Heard anything about the status of the girl? did she think she got raped?

We were told, like I said, by a guy that knows his stuff, that if alcohol is involved, and she says the next day that it was rape, that it is. Personally, I'd take the word of a professor of sex education(an odd title don't you think?), over people from AT.Even if you're not married, it's still not rape if you take someone out to dinner, have a glass of wine, and go back home and get it on.

So you still consider it rape even though she doesn't huh?

Good question, thats the first i thought of too the next day in school. i saw her, but i didn't hear any rumors about her or the incident. I'm sure i would heard of something thru friends if she had reported it or something. i i doubt she is going to report it, whatever her reason maybe, i dunno what they might be thou. we'll see, so far nothing's happened.
Rape laws are stupid like that. Technically, if a guy says he was forced into the sex, should he be able to claim rape? Sure. Can he? Who knows...do you know any guys that have reported it??That doesn't even make sense. Here in the United States, laws are not allowed to be biased based on gender. So, if both parties each have one glass of wine, and then have sex, either one of them can say they were raped the next morning? How about if they BOTH say they were raped? By your definition of rape, they both were.
Show me any law from anywhere in the US that says someone was automatically raped if they had ANY alcohol in a specified time period before the sex act.

Make sure you tell any prospective girlfriends of yours that you had a friend rape a girl and you know about it, but you did nothing about it. You will definitely gain someone's trust that way.Originally posted by: HakunaMatata

And you show me a law that says it isn't rape until she is about to pass out.

Ideally, this is true. In reality, when it comes to things like rape, divorce and domestic violence, it's a lot easier for a woman to get a man on trumped up charges than it is the other way around.
Well, it is unanimously agreed upon that it is rape if she is almost passing out, so there must be a law about it somewhere. Wherever you find that law, you find what I said as well. The way laws work in this country is that everything is legal unless specificaly prohibited. Therefore, laws will not be created to define what is legal, but only what is illegal. You might as well ask me to show you what law allows us to breathe air.

I did answer. Read the thread before responding sir.

Not rape. If she was half asleep, that means she was still half awake. But it was still a horrible thing to do, and you do need to find a new friend.
Rape = forcing a girl to have sex with you.
Not rape (but still bad) = taking advantage of a girl who got into the situation by her own stupidity.
