She says NO -> Illegal
She doesn't say anything (she's passed out or something) -> Illegal
She says YES (drunk or not) - Legal

Legal or not, this guy sounds like a douchebag.

yeh. Rape unless he was just as wasted as her.
Still rape. Hell his "friend" even offered her to him.

Yeh but assumption here is that if his ahole friend was just as wasted as her, he wouldn't know what was happening or what he was doing.

anyways she comes to and says something along the lines of "f--- me"... so they get it on. it's not rape cause she wanted to do it, even though she was trashed, but damn, it was one awkaward morning.

Didn't they convict one guy of raping a girl who said almost the very same words to a guy when she was drunk?

Yes, it's rape, but I don't feel bad for her. It's like parking a mercedes in the middle of the ghetto, leaving te keys in it and rolling down the windows.

hmm, thanks for the replies, they confirm my suspicions too. I'm sure what he did was wrong, because jen looked really wasted, i doubt she could even remember what happened that night.

I don't think i'll be calling the cops, because what happens if she can't even remember the incident, i would probably end up looking like a fool then.

not true. If she is drunk, even if she says yes, you can still be convicted of rape. As bad as forcible rape? No. But convicted nonetheless.

Oh boy...here we go again.

I'll say this much.

Last night, your wife threw you down on the floor, ripped your clothes off and raped YOU. But you liked it...
This morning, you had a bigass fight...for the 8th time this month. She got mad, called the police and claimed you forcibly raped her.
Guess what? You are now GUILTY of raping your wife. The woman is believed 99% of the time (and about 98% of the time, they are telling the truth)

Sex is very scary these days.

He obviously knew since he was "thoughtful" enough to inform others. Who knows what else could have happened to that girl.

You are just as guilty as he is now.

I'm not a lawyer, but if a person is inebriated or under the influence, there's a good chance that it's not legally considered consent.

Well there is this girl, who my friend asked out, but she flat out rejected him. anyway last weekend there was this party at some jocks house and me and my friend were there and so was this girl. Everyone was drinking, smoking pot and just making noise, just partying i guess. i was outside the house having a smoke when my friend came upto me and told me what happened. He said she was wasted, she was basically half asleep, just plain drunk, so he took her to the washroom, where they had sex. he then said if i wanted to i could go up and have sex with her, because she will probably sleep with me too because she's a slut. What i find very disturbing is he said she wasn't very good and he doesn't know why he had a crush for her, all this time. anyway is it rape if a girl doesn't say no or not barely unconscious during the act?

I read the second sentence and knew the answer was YES. ANYTIME alcohol is involved, be she conscious or not, it is STILL rape. BEWARE of drunk girls, especially drunk girls that would have rejected you sober!

Ok, that's bullsh!t. It is not rape anytime a girl has had anything to drink. In this case where she was half-unconscious there's a problem but women generally can have a few drinks and still know what they're doing.

You must either be very young or have no experience with alcohol.

Yes. This is called date rape. This wasn't consensual because she was too wasted to make any sort of rational decision on her own. I believe your friend was not wasted because he even asked you if you wanted to have sex. He belongs in jail. :|

I agree. That guy screwed her and then asked you to do the same while she's passed out drunk???? And you're asking us whether or not it's rape????

you are right. a drunken "Yes Fuk Me" can still be considered rap cause they were under the influence

And if she does remember it, then what? Call anyway. Look like an ass, at least you'd be doing the right thing.

that is not date rate... date rape is slipping a roofie in a girls drink with the intention of getting with her

Either that or Drexel forced the freshman body to attend an assembly on date rate, given by a sex ed professor from a major university in Richmond. I guess he probably doesn't know though, right?? It is rape, they even showed us court cases of that EXACT thing happening, and guess what? The guy was convicted. Don't tell me what I'm saying is bullsh!t when you don't know what's going on.

I don't care how good a "friend" this guy is. You need to do the right thing and contact the police. Hell, what is he going to do if the girl is pregnant?

I would say it is rape in all but name.... technically perhaps you could say it isn't, but in reality it is.. more or less...
