An Athlon 64 4000+ costs AMD the same to make as does a 3000+, just like a 3.8GHz P4 costs Intel the same to make as a 2.8GHz P4. If this were not the case - if a 4000+ cost 33% more to make than a 3000+, then overclocking would be a different issue - it would be stealing, in effect.

Both AMD and Intel are well aware of users overclocking their processors - why do you think AMD released the fully-unlocked FX line?
Overclocking isn't the final answer in getting a higher performing system.
If I were to successfully overclock my K6 to 2.00Ghz, would I be getting Athlon 64 performance? Not quite.
Overclocking is a temporary measure to boost performance, until superior architectures are released.

If OCing is illegal, then a lot of mobo makers are going down with us.

ATI and Nvidia encourage OCing on their cards as well, both include OCing tools in their drivers. Heck, ATI's OC automatically.

Of course it's not illegal to abuse your own property.

However, suppose you overclocked and/or overvolted, in violation of the warranty, and damaged your CPU or another system component. If you then went to the manufacturer and sought warranty relief, THAT would be highly unethical (and probably illegal, since implicit in your warranty claim is that you've abided by the terms of the warranty; since you violated those terms and were still claiming relief, that would constitute fraud).

Bull$hit. You paid money for a piece of silicon. It is then yours to do with as you wish plain and simple. You did not purchase a license to use said piece of silicon in specific manner or at a certain speed. This doesn't even fall under the grey areas of IP law.

Overclocking is not illegal, I can tell you, I am studying Law (will finish next year). When you are overclocking you are trying to get the most from the product you have bought (and you are giving it the right use, the use/purpose it was designed for, Central Processing Unit), no one can tell you not to do it. Another ex; When you buy a car, for example, a Porsche, you are not acting illegally if you modify its engine (respecting the Law concerning to cars) in order to get more horsepower. It's the same.
