I'm hard pressed to think the courts will allow the willful violation of the decree while the case(s) work their way though lower courts and eventually (maybe) to SCOTUS. Like the DACA canceleation it will take months or even years for this to run it's course and courts would probably be sympathetic to resetting the situation to previous policy in the meantime.

You are right that the Republicans on SCOTUS are more likely to rule that the government can indefinitely hold children in extra-legal concentration camps as long as they are brown and their parents are with them, but I think that the rest of the court will convince them otherwise.

So the government withdraws from the consent decree (which involved litigation about unaccompanied children but the consent decree somehow gotten written without that distinction as just "children") the matter goes back to court which is ultimately decided by SCOTUS which has a 5-4 margin. Even if the SCOTUS rules against the original Reno v. Flores case was still about unaccompanied minors. Thus even if the government loses the case if they withdraw from the consent decree it would take another case to stop the detention of children with their families since that was outside the scope of Reno v. Flores. The consent decree actually went above and beyond what was being litigated in that case.

So we now know that some of the children being separated are being flown around the country by HHS in order to be detained indefinitely.

An American Airlines flight attendant spoke out today about how her flight was contracted to move children. Confused about why they were "dressed like criminals", the flight attendants were told the kids were a "youth soccer team". The administration has been forced to lie at all levels to carry this out.

Well now American, United and Frontier have refused to provide the government with the use of their planes to carry out this policy.
