Keeping the children detained indefinitely would violate the consent decree the federal government is a party to.
I'm hard pressed to think the courts will allow the willful violation of the decree while the case(s) work their way though lower courts and eventually (maybe) to SCOTUS. Like the DACA canceleation it will take months or even years for this to run it's course and courts would probably be sympathetic to resetting the situation to previous policy in the meantime.
Glenn1's certainty about the scenarios here is...odd.
