actually I would be all for those who have medical marijuana scripts/permits being denied the right to carry concealed.

Maybe we should extend that to all psychoactive prescription drugs like tranquilizers, sleep aids & anti depressants.

Probably not, huh?

absolutely we should, why would anyone in a compromised state have the ability to carry a concealed weapon?

You should be all for this no?

A state issued "medical marijuana permit" can't pass a background check either way.

When filling out Form 4473 if they tell the truth they fail. If they lie and get caught min. 5 years(?).

.

If Hawaii reports to the FBI that your friend has a state issued "medical marijuana permit". He won't pass a background check.

Don't know if Hawaii reports it or not. Some state do. Maybe all, I am not sure.

His "medical MJ permit" is what he uses to pass his company drug test as an "essential employee". Works for him but I really don't think it's real. I tell him it's all good that way to calm him down when he goes off the rails and starts zeroing in on something or someone. Fellow Viet Nam vet still dealing with issues from back in the day so......😉

I see!

Context Matters😀

I'm sure Hawaii will use the list of arrests to restrict people from their other 'rights' like voting or receiving welfare, correct?

Bullshit. This is the question on the form-

Are you an unlawful user of, or addicted to, marijuana or any depressant, stimulant, narcotic drug, or any other controlled substance?

If you answer YES to using you will not get a pass.

If you are using it is a unlawful use. Per federal law.

And all a prosecutor would need is a jury who'd actually convict for that. The law is one thing but where prosecutors are willing to go is often entirely another. They avoid opportunities for jury nullification like the plague.

Besides that, how would they ever know?

jury nullification? lol. go for it and let us know if the jury takes pity on you for lying on a federal form.

Cool, since we're in the business of making databases full of people exercising their rights, let's keep one of everyone having an abortion in Hawaii. Surely that will be in good clean fun, especially once a hacker gets it and posts the names on 4chan.

What would be the purpose of that database?
Gun permit databases certainly have a lawful purpose.

Heh. They sure as Hell won't find that jury in the Denver federal courthouse. They won't even try because of the law of unintended consequences.

Under the guidelines set forth by Congress & the DoJ State law overrules federal law wrt to cannabis in general & MMJ in particular.

Beyond that, there's no way for federal prosecutors to know or care about it unless some other federal offense is alleged.

So, duh-verting abortion threads into gun discussion and gun threads into abortion discussion elucidates the conversation how, exactly?

Is it possible the jury could be made up of pro-gun control people?

Besides that, how would they ever know?

per the link earlier:
The FBI has requested that if LEO's learn a person has a state issued permit. To forward that info to NCIS. Even if they are not involved in any crime.

Actual quote, please.

Hawaii seems to be making a lot of databases active lately.

I actually had a had an issue in Florida not too long ago where I was registering my car again after living here 25 years, and a issue was flagged from Hawaii in 1984 where I had sold my old beach beater 1968 Dodge Dart a few weeks before I left and it had throw a rod. I'd bought it from someone who had probably had it handed down several times over the years.

I was marked on a list from 30 years ago because I had not turned the plates back into the DMV in Hawaii back then.

I was lucky I had a supervisor here helped my with it quickly and did not cost a lot, $30, but that was a bit ridiculous.

Actual quote, please.

Flushing Police Chief Mark Hoornstra said his department adopted the procedure about six months ago following a training seminar organized by the FBI, which was attended by about a dozen other Michigan law enforcement agencies.

Under the procedure, Hoornstra said his officers report any interactions with individuals identified as medical marijuana patients to the National Instant Criminal Background Check System, or NICS, even if they are not committing a crime or violating the Michigan Medical Marihuana Act.
