That's terrible advice. The campus "judiciary" systems are a joke and downright criminal in the way they handle on-campus offenses. There was a girl at my school who was raped by this guy and, because she called the campus police (or someone did), he got to go in front of nine undergraduate students who decided his fate. The guy should have been in jail.

Two guys I knew were busted smoking weed in their room for the 3rd or 4th time. Their punishment? They had to move from the freshman quad to upperclassmen housing.

Another guy I know was busted smoking a joint while walking down the street by a campus cop. He had to complete a 20 minute online seminar about why smoking weed is bad for you and, I think, he was put on housing probation (one more offense and you're barred from on-campus housing).

The student judicial system at most universities is completely broken.

No school judiciary system supersedes a criminal court. If she chose not to press charges and persue it in criminal court I have no sympathy.

Last I checked a college didn't have sway over the US judicial system when it comes to rape charges. They may have told people that to sway them not to talk and deal with it in house, but if they did that to the girl then that's as bad as the rape IMHO

I stand by my original post. If he gets charged, he must (should) get a lawyer. Expungement is a possibility as is dismissal. But the odds of that happening in this day and age WITHOUT a lawyer is practically zero.

There have been several replies in this thread...words to the effect of "I got caught with all this pot and I got off completely." Well, you got lucky; not every is so lucky. I got caught with A JOINT, didn't pay any fine nor do any community service and the damn incident is still on my record.

Hasn't kept me from obtaining employment, thankfully. But it's a PITA having to explain it.

It seems like a terrible situation. There was a NYT article a decade or so ago about this very issue. They had a dozen or so cases in which no criminal charges were filed against students for a variety of crimes. Their argument was that the universities don't want to be sued, so they encourage their counselors and RAs to keep things in-house. That explanation makes me wonder why a lot of these students didn't press charges later on.

Why an RA wouldn't immediately call the real police when they found out one of their students had been raped is completely beyond me. Even if it meant losing my free housing, it's the right thing to do.

Don't forget your experience was about 20 years ago and when the whole "Just Say No" campaign was in full swing. I'm not saying you're wrong, but I'm thinking things my have changed a bit since then.

Seriously though they should toss him in jail for a bit.
