As in any transaction, you go to see a Doctor, he tries to help.

He didn't ask for you to come to him... you came to him, you and he were in a mutual agreement.

If he fucks up, suck it up.

These guys do what they can, to the best of their ability, when YOU come to them and ask them for help.

they weren't helping, that's the thing. they had tried to talk him out of going to another doctor because they had severly mess up and were trying to get as much out of the insurance company as they could. there was plenty of blame to go around here. even his insurance company wasn't off the hook because they had saw what was going on did nothing until he got his settlement and then tried to get reembursed. his lawyer, who doesn't normally do mal-practice suites, said ok, but after we pay you, you will be sued too.they dropped it after that.
 
Ultimately, the blame lies with him.

His Doctors.

His Insurance Company.

At some point he has to take responsibility for himself.

because he had the bad luck of choosing a lousy doctor? the doctor should have recommend a more qualified surgeon but didn't because he saw dollar signs.

so you don't think doctors should be held accountable. that is what you are saying.

Yes. He chose the Doctor, and therefore bears the brunt of the consequences.

It's a mutual agreement, when you choose a Doctor and pay them for services.

You can't back out and cry foul.

This "Doctor," btw went through all the prescribed state tests, etc., to achieve that distinction.

Maybe you have a problem with the state, or whatever authority awards that distinction.

No, I am saying that you and he had a mutual agreement. You would pay him, and he would try and help you.

Somebody's failed. So you go in to get left knee rebuilt and when you wake up right knee was replaced you can't sue in your world?
 
No, it's malpractice INSURANCE, and lawyers sueing any Doctor around, and it's why our health system is in so bad shape.

You contracted with the Doctor. He did what he could, even if it wasn't enough.

If you were seeking a surgeon, and he represented himself as a surgeon, that is fraud.

Absolutely not. You made the choice to go into surgery with these people. They tried to help you, and made a mistake.

Any blame is yours for picking them in the first place.
