any laws on the topic? I was sent the wrong item from a business via mail, do I have to ship it back?

My thoughts are that there are some people who honestly can't see that their actions affect the rest of the world. They only look at the immediate consequences and aren't able to look at the big picture. Its probably a product of the Nanny State world we are living in. No need for personal responsibility or accountability. Just do what's good for you and let someone else deal with the rest of the world.

It is funny you whine about personal responsibility like it is somehow the OP's responsibility to clean up the Company's mistake.

All he had to do was put the prepaid shipping label on the unopened box they sent him. That's not too much to ask. I am sure they would have even given him a credit as a courtesy for doing so.

And all the company had to was take responsibility for its mistakes and not try and pass it onto another person.

They are trying to take responsibility. They refunded his money and sent him a shipping label. WTF do you assholes want more? Should they fly someone out personal to your precious little house to do everything for you because you're an inconsiderate first rate asshole who can't just use common courtesy to help in fixing a mistake? Are you so self absorbed and think the planet should revolve around you that you can't simply be a good person and try not to fuck over a company for over a thousand dollars because of a mistake? You sound like a quality person. Lord knows NO ONE SHOULD EVER inconvenience you in the least and that you are god like and never make mistakes. You should pay dearly for all your mistakes accordingly.

Grow the hell up. Act like a decent human being and send back the TV. It would take him less time to fix the problem than to come on ATOT and bitch about it for several days. This ahole is doing nothing more than trying to get something for free. Period. Karma is a bitch and hopefully it?ll pay him back in spades.

How does canceling the OP original order mater at all? They had to either ship the TV that was ordered or refund the OP the money. It would be illegal for them to do otherwise.
They refunded the money that the OP paid for the 32", apparently once the 42" unit arrived, the OP did not want anything to do with the 32" unit.
The OP has indicated that he does not want the 42" at the price that they are offerering.
They have provided a mechanism for him to ship back the 42" unit.
He has refused to ship the unit back.

No, he was willing to ship back if the company was willing to have shipping company pick up the tv from his house. USPS seems not offer such service for such big product so they wanted him to drive to post offic eand do it him self which he refused.

so then it's okay to keep it in your book, right? he refused to work with them. regardless of the fact he's lazy, which i would expect nothing less of anybody living in california, since the lot of you grew up on your mommas teat and are used to living in refusal of reality.
the biggest mistake the company made was refunding his money in good faith. the company should have withheld the credit til he returned it.
it's posts like this by the OP and by you that makes me smile everytime there is a wildfire in LA, or a mudslide. While not all people in cali are bad, you two certainly make a good stand of showing how worthless you are.

Yes in my book it's okay to keep it. If it was me, i wouldn't even have called the company to begin with and i basically would ignore them. I also would not have any problem if they didn't refund me the money for 32inch tv.

The part of USPS seems fishy. Such a large item is not sent via the USPS but UPS/FedEX, etc.

However, if he had not gotten upset and blown off the CSR, he could have explained that he was unable to deliver the unit to the local PO.

However, the PO does advertise a pickup service. He was unable to work with the company (and implied it many times by his posts).

I wouldn't go out of my way to bring that monstrosity back to the post office. I'd have to rent a truck, load the thing in, drive to the post office and stand in line with the thing. He should just slap the label on the box, put it out front and call the company to tell them that if they want it back, it's ready to be picked up at my front door. Not sure about everyone else here, but I work 8AM to 5PM M-F and b/w driving to work (sitting in traffic) and the distance I have to drive to work, there's not much time, if any to make it to the post office before it closes.

If it's UPS or FedEx, then you can schedule a pickup yourself. Not sure if they charge your for it though. I've returned things before and the merchant has always been able to schedule a pickup time that worked for me.

Why should he? The company screwed up and not him. They should shut up and have kept the money for 32 inch. Now they don't have the money and he is keeping the tv, so they get nothing.

He screwed up by being a dink on the phone to them. Do you think they didn't want to handle this the easy way?

Why are you involved in this? Have the mods checked to make sure this isn't the OP's second account?
I think an IP check is in order. This guy seems way too far up the OP's ass.
With the ethics he has I'm sure having more than one account here would be an easy thing for him to pull off.

I would return it and not be a douchebag. Karma is nonsense but keeping the TV would not feel right.

With that said, if the company is unable to arrange a pickup, I do not see why you should have to take that thing to the post office. It was the company's mistake and it would be unreasonable for them to expect you to go out of your way to fix it. If they want the TV back they should arrange a pickup or something else reasonable.

Yeah. I don't think USPS ships such items to individuals. There is absolutely no doubt that the company would have worked with the OP to have their stolen merchandise picked up at his place.

THen again, the trolls completely ignore the fact that everything that they claim is the company's responsibility is indeed the OP's, when you consider he opened and destroyed the box.

The company should refuse to send a box, and politely offer to press charges if the TV does not arrive at their warehouse by next week.

I've lived in different parts of the US (born/raised East Coast). One thing that's far more true than your ignorant blanket statement is that dipshits/rednecks/morans/whatever stereotype you want to lump can be found anywhere. case closed.

(Though there are a shit load of terrible Asian drivers out here; something I never saw in the east or in the midwest. This is the first time I understood that asian driver stereotype I keep reading about on AT. go figure :p)

fuck I miss my annual trips to Summit county. My jerkoff of a friend moved with his family back to Raleigh area after finishing his PhD in Denver. :(

I've only been in Berkeley for 3 months now, but looking forward to trips to Tahoe. I was in Chicago for the previous 5 years+. Great city and place to live, though nothing but flat and /wrist-inducing boring for the surrounding 500 miles.

we about died laughing when one of our friends asked if we wanted to go to the snow. we looked at each other and had no idea what the hell that meant. well after 3 years, we know, and we keep telling them they should come out to our house (9155ft altitude) and try to get out of the snow. it's been snowing for the last three days....
i will give that to LA, between newport beach and the mountains to the east, LA has a good amount of variety. too bad LA is in the middle and gets in the way. Not a fan of the 5.

lol.. yea California, you know they really suck.. except for that whole thing about driving the U.S. economy

yep. let' slump another segment of the US population into the other lazy, self-important criminals crawling out for this thread. This has nothing to do with Californians.

It has everything to do with a bunch of dipshits.

oddly though, the op is east bay i think, and the other one, loser001 is also there. (at least by his jury duty post he is)

hey guess what, I'm living in "East Bay." There's a lot of dipshits here, but also a lot of decent, kickass people.

This is the first time I understood that asian driver stereotype I keep reading about on AT. go figure :p)

psst. i am only directing this to the parties responsible. my wife is in anaheim right now til christmas, we usually go every year at the end of the year and stay through new year, but this year i decided to stay home and play in the snow rather then "go to the snow"
amazingly, all my friends (err. most of them, live in the anaheim hills area around imperial hwy and lapalma. i know that area too well.

fuck I miss my annual trips to Summit county.

I like Bay area as it seems to be closer to a bit more things. namely Napa, Sonoma, Yosemite, Tahoe, and Napa.

Also Napa.

You didn't read the original post or you did and are being obtuse. The proof of your obtuseness is the fact that the TV was ordered. Insisting on the law based on unordered is just stupid and will get you smacked down for sure, should you try to raise it in court.
Since the TV was ordered AND there is a record of the refund and rejected return , there is ample grounds to swear out warrants on several charges, not the least of which is MAIL FRAUD, since it is within the bonds of most merchants to provide a multitude of shipping options and USPS does handle contract parcel service.
