How does child support work for women who re-marry? My brother in law is separated and pays child support even tho the ex re-married, shouldn't the new father take over all expenses for my brother in law's kid or is he still responsible, this is in CA BTW

Only if the step-father wishes to adopt the kids in which case your brother would lose all legal rights to them.

That said there are situations in which step-parent income is presumed available for the children most notably when it comes time to apply for loans/grants for college. Step-parent income is also calculated in situations like welfare program eligibility. Also, different states have different rules, in community property states,your brother's ex-wife has a new husband, half of that new husband's income is presumed to be available to her.. this added to whatever income she has from her employment could be reason to seek a downward modification in a child support order or if your brother starts making more money a reason to deny an upward modification.

I remember reading a story a long time ago about a guy who came into a condom and the woman saved it and got herself impregnated from the sperm. Don't remember if he had to pay child support in that case, but my bet is he did.

The problem is that the woman says they did have intercourse, and that's how she got pregnant. Funny that everyone assumes he's telling the truth and she's lying.

This was the first thought that came to my mind when I read the story. How do you prove you only had oral sex with the woman? Doesn't sperm die pretty fast in saliva? Did she rush into the next room to spit it into a test tube and freeze it or something?

I find it far more believable that she got pregnant the old fashion way.

In normal situations, when household incomes increases, any children living in the household generally benefit from that increase be it from being housed in larger quarters in a safer neighborhood, to getting higher quality food,better clothing, increased educational opportunities and/or cultural enrichment activities. Chances are good that a step-parent's income does benefit the overall standard of living of his/her stepchildren.

Didn't we have some similar thread to this a while back about whether a sperm donor would have to pay child support? The general consensus was that the child always comes first so even if she admitted it, I think he would still have to pony up. On the other hand, I have no problems with her thrown in prison and her child taken by protective services.

Yeah, that would help society One more prisoner to pay for and one more kid fucked for life. Any other bright ideas?

Really this isn't any different than a girl (because really... no WOMAN would do something like this) who stops taking her BC without telling her partner. At the end of the day he's the father of that child whether he wants to be or not.

In the end it's all about the child. The parents and their financial/whatever needs are secondary to the needs of the child... regardless if the mother is a psychotic, lying sack of poo. Most of you seem to overlook that point. Once there's a child in play it stops being about YOU and what YOU think is fair.

Child support laws are insane though. they need to stop the 25% for the 1st child bullshit. i remember reading about someone paying something like $30k a MONTH in child support. thats just insane.

I am willing to bet the vast majority of women dont have the disposable income to use that as a paycheck. You think 800 bucks a month is a paycheck? This is 10,000 a year for a single child. Between food, medical needs, school supplies, toys. 800 bucks a month usually wont cut it. My GF makes in the mid 60s and still lives paycheck to paycheck with child support.

It is real rare you will see a women recieve an ungodly amount of child support from a man.

Children are effing expensive.

Your calculations are at 50% though. Child support should be your part of supporting a child. So if it's an $800/month cheque, the cost of support should be $1,600.

At $800/month it would be cheaper to get joint custody and hire a nanny for your two weeks a month!
