How does child support work for women who re-marry? My brother in law is separated and pays child support even tho the ex re-married, shouldn't the new father take over all expenses for my brother in law's kid or is he still responsible, this is in CA BTW
Only if the step-father wishes to adopt the kids in which case your brother would lose all legal rights to them.
That said there are situations in which step-parent income is presumed available for the children most notably when it comes time to apply for loans/grants for college. Step-parent income is also calculated in situations like welfare program eligibility. Also, different states have different rules, in community property states,your brother's ex-wife has a new husband, half of that new husband's income is presumed to be available to her.. this added to whatever income she has from her employment could be reason to seek a downward modification in a child support order or if your brother starts making more money a reason to deny an upward modification.
