I believe the OP said that the neighbor was told by LL that op is a cousin to point out about how the LL is dishonest. They are not cousins, but for some reason the LL wants to lie to the neighbors about renting his home out.
Thats correct.

If he does not "rent" out the house, he does not have to declare the income from the rent.

TJ just gives his cuz a $2500 "gift" every month because they are so close. ():)

Oh I also forgot to mention that my wife has become friendly with some of the neighbors. She asked them the other day what kind of people the LL and his wife were and they didn't have anything nice to say. They also mentioned that the LL had told them that we were their cousins

If the LLC does not have the income, how can it be taxed on it? :\

If the LL "cashes" the check each month vs depositing it...

It think it's funny his attorney had asked him to do whatever the bank manager wanted. This is probably a law student buddy.

Once I have an attorney retained, I stop doing anything other than forwarding any letters that he may need.

Seriously its been 9 months of shit like this over and over. We haven't told him but we are in the process of buying a house. I can't wait to see the look on his face when we say PEACE OUT. We retained a lawyer and have enough information to break the lease.

Today, 3/20
The attorney said that if he wanted to proceed with taking this to court with the intentions of trying to evict us he would lose...... I'll continue to pay the rent and continue with splitting the oil bill.

So at first you are buying a house, but after the past 2 wonderful weeks you have decided to stay.

Makes perfect sense.

No, we are looking to purchase a house. We had our sights on 2 different homes but for various reasons they have fallen through. We have 2 other homes that we are considering. As bad as this situation is I cannot just pack up and leave. I am not moving my entire family for a couple months just to move again. Once we find our home and go to contract I'll be able to do more but for now I have to play this game.

well yeah. he needs a place to stay until he can move. i don't see how that's confusing or conflicting.

Thought the bank rules changed a long time ago on business accounts where the checks had to be deposited leaving a paper trail for the IRS.

Rules that are made can be broken :sneaky:

Apparently in this case, the LL and/or family are able to cash the checks without having to formally deposit them into the designated account.

Nope, nothing new for today. I was guessing that a certified letter would be in the mail today with the same information as the email. Maybe that'll come tomorrow.

No updates?

Nope, nothing new to report. Still nothing in the mail from the LL.

I plan to contact the bank today and just get something in writing from the branch manager that I didn't need to sign the affidavit. Thats just in case we have to go to court...that way I'll have evidence and I'll have everything covered.

My next guess is that I'll hear something back from the LL when I send his rent check certified mail. I don't want him coming here and I don't want to see him.
