Why are you doing anything when your lawyer should be?
LL has indicated that Chase found the account.
LL has not indicated if any ties to the account - only wants an affidavit.
So I got this email today from the LL
TJ,
You have not responded to my last two requests, sent March 15th and March 16th, regarding March's rent payment of $2,500.00 which I have not yet received.
It has been determined by Citibank that a affidavit of forgery be signed and returned to them. At that point they will collect the funds from J.P Morgan Chase bank. Once you have received said funds, the March rent payment can be made. Until then March's payment will be considered not paid, and action will be taken.
Let me know a day and time that is convenient for you to bring the form and have it signed.
I have CC'd my attorney on this email for his records.
Thank you,
Landlord

I missed that post then.
I'd like to know if there were any ties to the account, it all seems too fishy.

Got this follow up text from the LL last night
LL: Joe I am free tomorrow and sunday to drop off the money for the standard protection plan and half the difference of the oil bill and have the document signed so that your money can be returned into your account and march payment can be properly made. Please let me know if tomorrow or Sunday works for you. The sooner we can put this to rest the better. This situation can be resolved so easily and luckily your money was located.

I am very annoyed at you. I thought WW posted something, and I was going to celebrate. You guys done made the Den Mother mad.
It's more than likely an internal issue with the wrong account being credited. Happens occasionally.
that is not likely at all, as the proper recipient, the landlord, states he did not deposit the check.
There is only one way to settle this. What is your IQ?
Alky this isn't a domestic abuse case, bankruptcy/foreclosure, aggressive driving, or DUI, so your experience on what his lawyer should/should not be doing is pretty much baseless. In your situations the lawyer fully takes over.
It's not uncommon for a lawyer to give advise as to what you should do in MOST situations that are not as serious.

If you are smart why don't you make any money? Are you bettering yourself, or does your paranoid personality disorder preclude you from improving your lot in life?mine is around 160, but this was a very busy thread.

Maybe the OP should run-down the LL, get into a fight, take a few punches and then shoot the LL.
Oh I also forgot to mention that my wife has become friendly with some of the neighbors. She asked them the other day what kind of people the LL and his wife were and they didn't have anything nice to say. They also mentioned that the LL had told them that we were their cousins
Makes me question whether he's renting to you legally or not.
E.g., if it's a home he owns, sometimes banks forbid renting. Loans for home mortgages are lower than loans for rental properties. I.e., he may have an obligation to notify the bank it's no longer his primary residence.
If he's trying a tax dodge, the fact he's using an LLC may not mean much. If he is the only shareholder (technically often referred to as a "member) the LLC may be considered a disregarded entity by the IRS meaning it never files a tax return and they are, for all practical purposes, unaware of it.

I thought the same thing. I actually contacted the local town and asked if the proper paperwork had been filed to make the home legal to rent. The response I got was that there is nothing an owner has to fill out to make the home legal to rent.
Now, if the bank has an issue that is something I may explore as well.
I contacted the board of health in regards to the standing water on the pool as well as the water that has been in there for the past 3+ years. I haven't heard back from them yet.
I also did not get anything in the mail today from the LL. He sent me the threatening email on Monday. I think it was probably bait which I did not take. Had it been a serious threat I was expecting something in the mail this week.
I gotta ask...
It's seems at this point that your landlord wants you out. It also seems you want out as well. Given the mutual common ground, don't you think it would be best to contact the landlord and see if this is indeed the case, and negotiate some common ground (maybe a month or two) to find a new place to live and brush this whole drama under the rug?
Or is the both parties being reasonable at this point ship sitting aground next to the ship in Italy?
