HOUMA, La. (AP) -- A 6-foot-3, 265-pound man says a restaurant overcharged him for his trips to the buffet line, then banned him and a relative because they're hearty eaters.
A spokesman for the restaurant denies the claim.

Ricky Labit, a disabled offshore worker, said he had been a regular for eight months at the Manchuria Restaurant in Houma, eating there as often as three times a week.

On his most recent visit, he said, a waitress gave him and his wife's cousin, 44-year-old Michael Borrelli, a bill for $46.40, roughly double the buffet price for two adults.

"She says, 'Y'all fat, and y'all eat too much,'" Labit said.

Labit and Borrelli said they felt discriminated against because of their size. "I was stunned, that somebody would say something like that. I ain't that fat, I only weigh 277," Borrelli said, adding that a waitress told him he looked like he a had a "baby in the belly."

Houma accountant Thomas Campo said the men were charged an extra $10 each on Dec. 21 because they made a habit of dining exclusively on the more expensive seafood dishes, including crab legs and frog legs.

"We have a lot of big people there," said Campo, who spoke for owner Li Shang, whose English is limited. "We don't discriminate."

Labit denied ever being told he would be asked to pay more than the standard adult price.

The argument grew heated, and police were called.

The police report states, "The incident was settled when the management advised that the bill was a mistake and, to appease Ricky, the meal was complimentary."

Labit said he insisted on paying but was told not to come back. He complained that when seafood on the buffet line runs out, the restaurant only grudgingly cooks more.

Campo said the proprietress tries to reduce waste of quality food, he said.

"Food is for eating, not toys for your child," reads a sign posted on a wall in typewritten text. A handwritten addition reads "Or 20% added."

buffet places should be able to charge more. airlines should also be able to charge more if you weigh 3 times as much as a normal person and take up two seats. is it politically correct? Hell, no that's why I love it.

I avoid the Chinese buffets around here in the Houston area, they have so much MSG in their food that I once had a weird dream about Dr. Phil.

this reminds me of that simpsons episode where homer gets kicked out out of the seafood buffet for eating everything and not leaving.

They can charge more. They just have to sell a meal that says, 5 plates of crab legs, everything else all you can eat. Additional plates of crab legs $4.

But they didn't, they sold him all you can eat from this entire buffet. They should hold up their end. I don't have a problem with the airline charging you more if you exceed certain dimensions, but they shouldn't come up to you with a card reader mid flight and charge you extra. Just make the details public before the transaction and customers will choose where to eat/fly.

The restaurant was in the wrong. They can't do that. They can tell him not to come back, though.

yeah that was sneaky of them, but then again he comes in every week to eat sometimes 3 times a week for 8 months and eats $50 in food and expects to pay $9.95 each time?

It's called common sense and common courtesy and the fat dude just took advantage of the restaurant. One of my co-workers knows of a couple that have been kicked out and forbidden from certain places that have buffets. What they should have done was tell him before hand that they were going to start charging him double or forbid him entry(most places usually have a sign saying something to the effect that they have the right to refuse service to anyone)

But do the math 8 months times about 2 times a week on average, he probably ate $1500-$1800 worth of food and paid about $300 for it.

Why should the establishment have to eat the cost of someone who wantonly abuses the system?

They shouldn't. That is why they have the right to refuse service to him. However, you can't post "all you can eat" or "all you care to eat" for 9.95 and then charge double.

Because the customer didn't break any rules? You're conveniently ignoring the fact that while the customer took advantage of the restaurant, they ALLOWED him to by being lazy about their own policies. What are you, a buffet apologist? If they don't want lumbering buffet monsters destroying their profit margin, they should clearly state the limits.

That'd be a good way of cutting off what would probably be 75% of your customer base. :)

I've seen skinny people eat a ton, too. I'm a fatass, but I always seem to get outeaten at buffets by the skinny guys around me.

If it's advertised as all-you-can-eat for $x.xx then they should live up to that. If the restaurant has a problem with that then put up a sign "except for crab legs".

When I go to all you can eat seafood w/crab legs (like Phillips) I probably eat more than 8 plates of crab legs. I go through a lot of those buckets they give you by myself. But then I'm like 5'7" and 120lb (borderline underweight). Sneaky :p
