I recently bought a HD from Dell, listed as a 'Dell replacement part'.  It was a new OEM IBM drive, with no apparent indication that it had been rebranded.  The only difference is that Dell handles the warranty and it was 1 yr instead of 3.  It's kind of odd how Newegg got ahold of one of Dell's stock.
I think in your case, Newegg should definitely handle the RMA. From personal experience, they have been good at handling RMA's under extenuating circumstances.
