Paypal is very conveniant but crap like this keeps happening and paypal keeps ignoring the problems. That is why I don't have paypal and haven't needed it in over 50 trades/swaps

Down with Paypal!!!

Why, why, WHY did you ship to a non-verified member/address? That's an automatic exclusion from PayPal protection.
The buyer need not be "verified", only the seller need have a Verified Premier or Business account to qualify for protection. The buyer's address needs to be "confirmed", he need not have a "verified" account.
You are playing word games. I think it's quite clear that Pliablemoose shipped to an unconfirmed address.

Yep, automatically excluded from PayPal's protection:(

No recourse except through the legal system...

Guess I won't be using PayPal ever again:(

You have this guy's shipping address right? Go find that bastard and kick his arse!?!

Man that really sucks...I didn't realize you could get screwed so bad by PayPal. Are there better ways to accept credit card payments?

PayPal is not bad if you use a lot of common sense.

On an item that big and using ebay, I would've had a money order only policy.

Yep, I think all I can get is the listing fee back,

I did file a Square Trade complaint, the contact info through Ebay is to a Ford dealership in Indiana who's never heard of the guy, shipped the item to Queens NY:(
.. giving New Yawkas a bad name...

Oh wait, we already have a bad name...

How would that be 'quite clear' since "unverified" and "unconfirmed" are two different legally significant terms in the PayPal TOS? There is no such thing as an "unverified" address, only accounts are "verified". There is no such thing as an "unconfirmed" account, only addresses are "confirmed".

Confusing the terms leads to confusion. Does he mean the address is unconfirmed, which would automatically exclude the buyer from protection? Or does he mean the account is unverified, which would not exclude the buyer from protection?

Only he knows.

Will be talking to an lawyer tomorrow, PayPal's policies don't exempt them from state & fed law...

Once they're aware of the fraud, they have to behave... Or I'm taking them out baby:(

Quite simply, no, because there are rules with all merchant services, and if you don't follow the rules, you'll screw yourself just as hard with one than the other.

This isn't a PayPal problem, its a seller stupidity problem.

There's other companies that do it (c2it I think? It's a citibank serivce IIRC), but everyone uses paypal.

If you're careful with paypal I guess you're ok. If I'm selling something on ebay, I only take MO's. In FS/T, heatware is good enough that I can use paypal to accept cash.

PayPal is fine if you are willing to read and learn what is expected of you as a buyer or seller to protect yourself from this kind of thing.

But there are people who have, 20 times per day, for 20 years, looked at the health warnings on the side of cigarette packs and will claim "I didn't know it was bad for my health".

If I sell anything for over $100, then it does NOT go through paypal. That is just too much money to risk.

Update, took a little detective work, but the notebook sold to a car salesman in Indiana (he was using a different name on eBay?), and he resold it to someone in NY. Had to do a reverse lookup on the name on the CC used with PayPal & found out who it really was.

I just got off the phone with his boss & his mom, if he doesn't make good on the deal, I now have his address, phone #, place of work etc...

Seems his purchaser says they didn't recieve the item, so the eBay buyer decided to reverse the charges to me.

The guy's boss is going to have a little talk with him about contract law:D

If he doesn't make good, my local PD will have his local PD talk to him:D :D

PayPal & eBay are pretty worthless for disputes:|

Wow, that re-sale must be some trick. How did that work? Did he win, and then turn around and sell it to the next highest bidder? Sounds like a scam to me. What town in Indiana is this guy from? I don't want any more info than that. I just don't want to ever buy a car from this guy.

His boss was pretty nice...

I just found his auction where he resold my notebook:

eBay

Wierd thing is that the buyer who says they didn't receive it has good feedback...

Glad it worked out for you... at least starting to. I don't use paypal now either... give C2it a shot, supposed to be like Paypal but without the reverse charging.

So, did you ship it to him, or the second buyer? Who paid you orignally? It sounds like he bought it and immediately turned around and sold it. He then had the other party pay you, and you shipped it to the other party. Very, very strange...

Sounds like he's just trying to make twice as much money off the same product.

He scams you for the amount of the laptop, resells it and then makes 2x as much money.

Yep, if it wasn't a complete scam, his reselling went bad... horribly bad...

I sent him an email, offering to have the police & eBay deal with the scam if he doesn't make good...

He had me ship it to his buyer, holy crap I thought I was nearly unethical... This guy has got to be a good car salesman...

Here's an email form the buyer after I finally tracked him down:

"Well, I just want to say that I am not trying to avoid you or stiff you, I
wouldn't do that. As I said YOU WILL BE PAID! Whether I do or not, I will be
sure you do. When I won your item I bought another laptop and I didn't want to
leave you hanging so I resold it so I could get you paid. I'm not trying to take
the money back, I was told by my attorney to open the file so that paypal would
be able to prove you sent it to that address so we both get paid. When they open
the complaints they will see you shipped it and it did arrive. I want you to
send them the info you have proving you shipped it. I already contacted them by
phone and email with the tracking info. I told them exactly what is going on so
they know you shipped it. they will cancel the complaint in a few day I was told
so please be patient. I will even send you some extra $$ for your trouble. I
appreciate your help in this matter. Look at it like this, if we don't stop the
guy, he might do it to you next time and he would stiff you. And please do me a
favor, don't threaten me anymore, I'm with you not against you. I swear on my
life You will be reimbersed and some, just please be patient and help me out,
send them the info to prove you shipped it. If you can email me copies. that
might make it go faster.
thanks.
Let me know if you have any ideas."

>$100 would probably require money orders for me, unless the trader has an insane amount of evals from other people with insane amount of evals, etc.
