Update -

The guy STILL WON'T LEAVE ME ALONE! He keeps on harrasing me and filling all sorts of complaints. He insists I send him a battery (I have already refunded him $20 dollars for the battery I gave him FREE of cost that turned out to be faulty). He is just getting on my nerves :

"I'll continue to email you, follow-up through eBay, and
then seek the assistance of the Better Business Bureau, as well as
write you letters to your place of business. Ultimately, I will seek legal
remedy "

What should I do? I really don't want to waste MORE money on this @ hole and send him a new battery. Why are some people hard headed like this guy :|










I just got my first NEGATIVE ebay feedback! I am pissed because I think I did not deserve it and tried EVERYTHING to fix the problem. AUCTION LINK

Here is the feeback he left me :

"Extreme caution; false claims, not shipped, faulty product, unstable upgrade"


Summary for those who don't want to read the whole thing!:

*I sell an airsoft gun and promise the guy delivery before xmas
* I receive payment the 20th, leaving me 1 day to do the upgrades.
* I send the aeg overnight to the distributor to get upgraded
* It does not get there until thursday so it is impossible to get delivery by xmas
* The guy wants to pick it up from me personally but I am skeptical.....he also blackmails me by saying that if I do not give him the battery and charger he will leave me a negative
* I relent and throw in the battery and charger
* I am forced to wait for an order with the same AK, but one that is upgraded with more options
* THROUGHOUT THE TRANSACTION I ASK HIM IF HE JUST WANTED A REFUND BECAUSE THINGS DID NOT LOOK GOOD WITH USPS........he would give me a negative though
* I tell the guy that I will give him that gun free of charge after I receive it friday
* I allow the person to pick up the gun on x-mas eve....fulfilling my promise
* THe next day he writes me a letter expressing his disappointment that the gun does not work
* I blame the faulty battery or charger that I gave him for free
* I then refund him 20 dollars for the battery
*HE LEAVES ME THE NEGATIVE even after I aked him whether he wanted a full REFUND!





Here is our conversations we have had throughout this whole ordeal:

Even if you are not able to pick it up, it will SURELY be there by friday

As previously stated, my office is located in XXXXXX, XX and I would gladly pick-up the item today, Dec. 23rd. I am not in my office tomorrow and would not be able to pickup the item. The issue is not the price of shipping and handling, but rather receipt of the item in time for Christmas!

What do you mean affect the outcome? Shipping is 20 dollars and the battery and charger cost 25 so why would I just lose the 5 dollars?

Also, the package delivered from USPS was not the right one. I have been waiting for it, but it did not have your gun. The other box that was sent is still coming and I have no clue why they would be seperated!

I would be picking up the original order for the AK47 minus the shipping, so why would I pay an additional $5 when you indicated that these could be shipped together? And now, I would have to go out of my way to pick-up the item in order to have possession before the 25th of December.

You are not losing $5 - it is very possible that you will be losing $383.98 USD when I contact PayPal and revoke the transaction.

You did not have possession of either item when you promised it would be received by Christmas. I expressed concern regarding shipment prior to bidding on this item. I was also the sole bidder on this auction. I am quite dissatisfied and suggest you make amends. It is nearly 3:30pm PST, the day before Christmas eve and I don't intend to play word games with you.

Step up to the plate and make due on this transaction.

Ok, I will give you the battery and charger. I infact DID have the gun in my possesion during the auction. It is just I send the guns to my distributor to get them upgraded and they ship the aeg back to me. By going out of your way, you are saving $20 dollars so you should be happy :)

Please, you don't seem too happy.....and I have tried the best I could! I cannot help the SLOW holiday shipping delays and I was not expecting them to be this bad. Look, you paid me the 20th of december and that meant I only had 1 day to get the aeg upgraded. I tried me best and sent it overnight to them and they did the upgrades as fast as they could. You left me very little time for error and I thought it could be done for you. I should have said "no" and it would have been a lot easier on me. BTW, I am giving you the gun upgraded to 430 instead of the 400 fps (for failing to keep my promise). I am leaving right now and leaving your package at the guard station. Please leave me you name and any other info you would like.

Well, he emails me back and reports that the gun does not work. He again points the finger at me and blames me for the mis-hap. I suspect the FREE battery and charger I gave him are to blame. I offer him a refund and he does not respond for a couple days.

THen he tells me:
"I reviewed my PayPal account and note that you have not refunded the
$20.00 as indicated below. Please arrange for this transaction to be
completed at the earliest opportunity."

To appease him, I do send him the 20 dollars so I can get a positive feedback. Even after I do this, he leaves me the negative!

I then had my manager email him-
Hello, My name is Chris. I am the manager of airsoft n more. I was recently told about your situation. FIrst of all, we take pride in all of our upgrades, and have never ONCE had a problem with customers (check our perfect feedback that you erroneously chose to abolish). Secondly, our average upgrade stregnth for the AK-47 gold series has shown to be over three years... a low of 405 FPS to a high of 433 FPS. Our average is consistantly around 415 FPS. However, there ARE variances in each individual gun as no two guns are alike. Thirdly, your weapon is without a doubt one of the best replica's available and contains a TOP OF THE LINE metal body... you will not find a body of that quality without extensive research. We HAVE NEVER ONCE had a Faulty "unstable" upgrade, and our customers have never stripped gears, or broken anything in the gear-box.. Your comment on ebay was utterly false and unwarranted.

After reviewing all of your emails with my co-worker, It became apparent that we did everything in our power to placate your fears cater to your wishes... After the USPS held our shipment for three extra days, we became unsure that your weapon would get to you by christmas. Hence, we offered you a FULL REFUND. WE HAVE no control over the circumstances present during the holiday season... We were told our shipment was here, but we did not recieve it until December 24th (3 days late). Then, after your email warning us that you would leave negative feedback unless one of our employees physically went in his car to meet you 50 miles away was absolutely ridiculous. FIrst of all, who in there right mind would drive 50 miles at night to meet a complete stranger to deliver something in fear of the potential retribution if they didn't do so? As you stated, since you are a lawyer, you should be intimately familiar with the term BLACKMAIL.

Finally, to top it off, you stated that the battery didn't work... this was a valid complaint, and we would gladly replace it or find you a new one... WE take pride in what we do, I do not appreciate your unwarranted and falacious attacks on our reputation. I wish you would have taken our refund, as it has been a nightmare dealing with you. You are impossible to please, we have done EVERYTHING on our part to try to keep you, our customer happy... However, it seems that everything we do with you is in vain. Im sorry you are so hard to please, we have worked hard so that it wouldn't come to this. We even left you positive feedback and tried to put this all behind us. I sincerely believe that we did not deserve to recieve such negative feedback. If anything I think it would only be fair on our part to at least withdraw your negative feedback and leave something neutral. I understand as a customer, you are entitled to be happy, but you have to understand we were willing to give you a refund, give money back for the shipment, and are still willing to help you with your battery, However, well knowing this, you cold-heartedly chose to sabotage our pristine ebay record... the least you can do is leave a neutral feedback although i firmly believe we should have got a positive feedback like we left you...

I stopped reading about halfway. What I figured out is - you sold an item that you didn't have in your possession and promised it by a certain date. Probably not a good idea. You tried to charge the guy $30 for something you normally charge $25 for. Not sure why you did that.

It seems like you inconvenienced the guy a bit, but he also seems like a dick. I didn't count the number of times he said "Please advise" but I imagine it was more than a few.

If you read further he says he had the item when he auctioned it, but sent it back to the supplier for upgrades.

Sorry to hear about this. Someone gave me 4 negatives (4 seperate auctions) because he never shipped and I gave him bad feedback, it hurts when you get it and its not your fault.

Summary:

Auctioned item you didn't have in your posession.
As a term of the auction you agreed to have the item to the person before Christmas (this was clearly a Christmas gift and the buyers main concern)
The item was delayed (the shippers/ups/upgraders fault), but doesn't resolve your responsibility based on your promise.
You agreed to meet the person 'in the middle' to deliver the package.
You then decline to meet him and make him drive all the way to your location.
The gun doesn't work.

Yes, you deserved the negative.

3) IT DOES WORK!!!!! THEY DO NOT SEND ME ANYTHING WITHOUT TESTING IT
4) I never agreed to meet him halfway - I was a location right by my house, next to the freeway. To bad the guy could not meet me when I could go (xmas eve) and I had a party. This jerk was low on my to do list.
5) I offered a full refund.... how can I deserve a negative?

So true. You inconvenienced him and promised him something and then suddenly your party comes before a customer who just dropped $370 for a product as an XMas present.

WTF? You're just giving him what he paid for.

You deserve the negative. Here's what happened.

1. You sell the item, promising Christmas delivery. He buys the item, expecting the item before christmas.
2. You offer him some options, never once saying that adding any of these options will extend the shipment promise.
3. He wants his product.
4. You don't have the product that YOU SOLD HIM
5. You get his product, but can't deliver it because you have a Christmas party
6. He has to get the product from you on CHRISTMAS EVE in Southern California.

I'm sorry buddy, but you deserve the negative.

From what I read it seemed like you were okay. Then again I read about 1/3 of it so I dunno what changed by the end. Way too fvcking long. There's a gun called an AK47 in airsoft? Give me a fvcking break. The only people who play airsoft here are the rich little boys. Just for the gun being named that and the airsoft situation being what it is here, I would give you a negative rating.

After reading through this, you had a lot of chances to make this sale right or just admitting you f-ed up, but you blew it. Making transactions complicated by sending items to the manufacturer and expecting them to get returned before Xmas is just asking for trouble, seriously. ITS THE WEEK BEFORE XMAS, TAKE A GUESS WHAT MIGHT HAPPEN TO YOUR PACKAGE???

As soon as he threatened neg feedback, you should have reported him to eBay btw...

Yes, there are AK47 airsoft guns -- also AUGs, M4s, M16s, FN P90s, M1A1 Thompsons, and quite a few more.

I hope to god you did not leave him a positive...

I have gotten a few threats but none have came through, generally they are from low feedback bidders who either don't follow the terms of my auctions or just don't know what they are doing and end up paying more for an item than they wanted to....

now I will not leave feedback as a seller until the buyer leaves feedback and as a buyer I will not leave feedback until I recieve the item and am happy with it....

I also email sellers as much and as often as possible when I have questions and I would hope that buyers would do the same for me as I would much rather resolve via email than through neg feedback.

sorry but some ebayers are a holes.
