So I'm going down the highway, comming home from work.. and I come to an onramp..

This lady is merging infront of me, but I was going pretty fast and didn't feel like I had time to slow down, so figured I would just pass her, thinking she would slow down and pull in behind me. That's not what happened, though.

She kept going, and she was right next to me when her lane ran out. I guess she didn't see me, because she pulled out and the side of my truck took her drivers side mirror off. I think that's the extent of the damage, our cars didn't hit eachother other than that. She said that she thought she was in her lane already. :roll: I really don't know who's fault it is. She was ahead of me, so I guess I should have judged the distance better and slowed down. Dunno.

Anyway, I agreed to just pay for it out of pocket so we didn't have to involve insurance.

So anyway, how much do you think a new drivers side mirror for a Ford Focus will cost? 😛 🙁

Edit: Settled with her. 120$ for the mirror is all she wanted. No big deal I guess. At least it wasn' t 300.. lol

Edit: Update2 - Met up with her and paid her today.

Here's the paper she wrote out and had both of us sign.

(Me) and (her) ("the parties") desire to enter into this agreement to provide for full settlement of any and all disputes and claims between the parties arising out of the auto collision of December 1st, 2005 on I-84 in Portland, Oregon.

(Me) expressly represents that he is and was at the time of the collision, the owner and driver of the vehicle invoved in the colision, a Chevy pickup bearing the Oregon license plate XXX XXX. (her) expressly represents that she is and was at the time of the collision the owner and driver of the other vehicle involved in the collision, a Ford Focus Wagon bearing the Oregon license plate XXX XXX. Each party agrees that there were no passengers in either vehicle.

Both (Me) and (her) expressly represent that they have express authority to enter into this agreement on behalf of any co-owners of said vehicles and hereby each indemnify the other from any and all claims brought by any co-owner or third party arising out of the collision.

In consideration of (my) payment of $120.00 to (her) at the time of signing this agreement, the parties completely release and forever dischage eachother from any and all past, present or future claims and damages, which now exist or may later exist, arising out of the collision. The parties agree that this is a general release and waiver of all claims arising out of or related to the colision, whether known or unknown at the time of signing. The parties agree that this is a complete settlement of doubtful and disputed claims and that this agreement will not be construed as an admission of liability, as each party denies liablity.

(me) knows that (she) is an attorney and agrees that she has neither given him advice or purported to act in his best interest with regard to this agerement. (me) agrees that he was given opportunity and sufficient time to seek independent legal counsel before signing this agreement, and that if he has not consulted with an attorney it is by his choice and because he is satisfied with the terms of this agreement. The parties agree that they have fully read and understood this agreement and enter into it voluntarily.

The parties agree that this document contains the entire agreement with regard to the collision.

This settlement agreement and release shall become effective upon signing.

Never count on the other driver to do the right thing. If you want something done right, do it yourself.

They're ~$30 on EBay - figure ~$50 from a junkyard, $100+ from a dealer.

That's unpainted though - not sure if they have painted mirrors or not.

I wouldn't have agreed to pay it, I don't believe you were at fault. She is responsible for merging into traffic without hitting anyone.

Yup. She's supposed to yield to you in that situation.

Although in general, I'll usually let them merge in front of me if they're ahead of me coming off the onramp, because even if I'm not technically at fault if someone hits me, it's still a huge pain in the ass dealing with an auto accident.
 
People in the main lanes are not obligated to slow down or let anyone in. If they have to wait to merge in then they have to wait. Her fault, you shouldn't have offered to pay.

It's really not a big deal, just my first accident, lol. Glad it wasn't worse. Just trying to get an idea of the estimate she will come back with.

Took me 15 minutes to replace the drivers door mirror on my 96 Stratus. The mirror cost me about $75 shipped. The Dodge dealer wanted close to $300 to do the job. 😉

Lesser roads yield to greater roads. Terminating roads yield to through roads. Alleys yield to streets. Gravel/dirt roads yield to paved roads, and so on. In this case, onramp yields to highway.
 
bradruth - How does that apply when they're both leaving a highway for an onramp? Sorry, it's just not clear to me.

I must have come up on her fast or something, because she said she didn't see me. But she did maintain that "I hit her.". She thought that I changed into that lane just before that, but I had been in the lane the entire time. 😕

I was almost past her when we hit.. the scrape from her mirror is on the back 1/4th of my truck. Don't care about that, it's just a beater anyway. But still.. the whole thing is kinda weird.

I'm guessing you mean they're both leaving the highway for an offramp and they're somehow side by side? The lane that terminates would be designated as lesser. If I'm misinterpreting what you're asking you'll have to be more specific.
