I was almost past her when we hit.. the scrape from her mirror is on the back 1/4th of my truck. Don't care about that, it's just a beater anyway. But still.. the whole thing is kinda weird.

She can maintain whatever the hell she wants, but she was in a position to yield, and thus it was her fault.

"She didn't see me" means that you were in her blind spot. That's her fault, not yours.

I'm guessing you mean they're both leaving the highway for an offramp and they're somehow side by side? The lane that terminates would be designated as lesser. If I'm misinterpreting what you're asking you'll have to be more specific.

Thats's what I'm thinking, that when he said: "So I'm going down the highway, comming home from work.. and I come to an onramp.." he was referring to an offramp. I'm just used to picturing highways as the elevated roads.

Not your fault. Should have filed a police report. Tell her to report it to her insurance company.

This lady is merging infront of me, but I was going pretty fast and didn't feel like I had time to slow down, so figured I would just pass her, thinking she would slow down and pull in behind me. That's not what happened, though.

She kept going, and she was right next to me when her lane ran out. I guess she didn't see me, because she pulled out and the side of my truck took her drivers side mirror off. I think that's the extent of the damage, our cars didn't hit eachother other than that. She said that she thought she was in her lane already. I really don't know who's fault it is. She was ahead of me, so I guess I should have judged the distance better and slowed down. Dunno.

Anyway, I agreed to just pay for it out of pocket so we didn't have to involve insurance.

So anyway, how much do you think a new drivers side mirror for a Ford Focus will cost? :p :(

when her lane ran out where did you expect her to go?

I think he's saying that the woman was coming from the onramp and that he was continuing travel down the highway.

I swear the onramp must be one of the worst in the Portland area. It's literally like, 100 feet. It causes traffic to back up bad when there's any significant load, because everyone has to slow down right there to let people merge... because the merging cars are only going like 25, lol

Brakes? lol

I was speeding up to make it easier for her to merge in behind me.

Should police or insurance get involved, you better hope they don't know you feel this way.

bradruth, your explanation makes more sense than what I was visualizing.

That's HER problem. Not to mention, those fvcking white lines are NOT impenetrable. It's NOT the end of the world to ride on the shoulder for a few seconds!

try manhattan FDR south bound. it literally scared the crap out of me when I tried to merge.

you were probably at her blindspot when that happened. what else would she say if she didn't say she didn't look?

If you were just a little more patient and stayed behind her none of this would've happened.

I believe that merging onto a highway is slightly different than good ol' regular merging. At least here, the rule is that if you're in the main lane, and there is someone who is trying to merge, has their signal on, and is up to speed, you have to actively allow them space to do it (slow down if behind, etc).

What she does when her lane runs out his not his concern. He should drive as if she's not even there, because if he tries to anticipate what she's going to do, and she tries to anticipate what he's going to do, it'd be a mess. I've been in situations where I've slowed down to let someone in, then they slowed down, etc. It is HER responsibility to merge into traffic.

And if she hit the back 1/4 of your truck with her mirror, there's no way in HELL she shouldn't have been able to see your truck Eli. Don't give her a dime.

Why is everyone blaming Eli (even Eli!) when legally it was the other driver's fault (as evidenced by Bradruth's comments) and law as I knew it as well?

Uh yeah, if he wasn't going fast enough to be able to slow down this wouldn't have happened.

Completely and utterly her fault. I had the same thing happen to me, but I swerved way out of the way when she tried to merge into me. I nearly smashed into the car to the left of me cause I didnt really think she was that stupid, but I was too much of a driving noob at the time to understand that most women really dont know how to drive.

If I did hit the guy to the left of me, it would have been my fault.

At this point, every onramp makes me grit my teeth, Im utterly aware of whats on my left whenever an onramp is coming.

It happened again recently, I just braced myself for impact because there was already a car on my left. Luckily the dumb broad slammed on her brakes when she realized she was running out of lane.

We need much, much better licensing tests in this country. Too much focus on not drinking and how to handle ice rather than simple everyday driving.

A couple years back, my roommate sideswiped my other roommate's car (2000 Focus, IIRC) in the driveway of our house and snapped the (power) mirror off. The whole mirror assembly was $50 from an auto dismantler, and I installed it myself in 20 minutes. It was a really easy job.
