He said it was a really short on-ramp, you have no idea how much time he had to slow down or how fast he was going. We do know though that she was unquestionably at fault in the accident based on the info he has provided.

I wasn't speeding or anything.... I was going 50-55, the speed limit is 55 and the recommended speed for the corner we were about to go around is 45... so it's not like it was unreasonable or anything.

My thought was that if I slowed down and she slowed down then we would just end up in the same situation. But instead we both sped up and it happened.

We both misjudged. Well, she misjudged because she didn't see me, or so she says. I misjudged because I didn't expect her to speed up.

Settled with her. 120$ for the mirror is all she wanted. No big deal I guess. At least it wasn' t 300.. lol

Eli, you do realize that you weren't at fault, right?

On a sidenote, I picked up 2 aftermarket mirrors for a 98 Nissan Altima for $85 off E-bay.

By paying for her mirror, you are admitting that it's your fault..
I would not do it. She can file police report after and it going to your fault and she can claim insurance also..
FYI... Always get police involved..

(Me) and (her) ("the parties") desire to enter into this agreement to provide for full settlement of any and all disputes and claims between the parties arising out of the auto collision of December 1st, 2005 on I-84 in Portland, Oregon.

(Me) expressly represents that he is and was at the time of the collision, the owner and driver of the vehicle invoved in the colision, a Chevy pickup bearing the Oregon license plate XXX XXX. (her) expressly represents that she is and was at the time of the collision the owner and driver of the other vehicle involved in the collision, a Ford Focus Wagon bearing the Oregon license plate XXX XXX. Each party agrees that there were no passengers in either vehicle.

Both (Me) and (her) expressly represent that they have express authority to enter into this agreement on behalf of any co-owners of said vehicles and hereby each indemnify the other from any and all claims brought by any co-owner or third party arising out of the collision.

In consideration of (my) payment of $120.00 to (her) at the time of signing this agreement, the parties completely release and forever dischage eachother from any and all past, present or future claims and damages, which now exist or may later exist, arising out of the collision. The parties agree that this is a general release and waiver of all claims arising out of or related to the colision, whether known or unknown at the time of signing. The parties agree that this is a complete settlement of doubtful and disputed claims and that this agreement will not be construed as an admission of liability, as each party denies liability.

(me) knows that (she) is an attorney and agrees that she has neither given him advice or purported to act in his best interest with regard to this agerement. (me) agrees that he was given opportunity and sufficient time to seek independent legal counsel before signing this agreement, and that if he has not consulted with an attorney it is by his choice and because he is satisfied with the terms of this agreement. The parties agree that they have fully read and understood this agreement and enter into it voluntarily.

The parties agree that this document contains the entire agreement with regard to the collision.

This settlement agreement and release shall become effective upon signing.

Did you ever stop to think *why* she did all that? She knows that SHE is at fault and had successfully, and EASILY intimidated you into forking over money that she has absolutely no right to, until you signed her little document. Ridiculous.

Yeah, I'm sure she had her best interests in mind first and foremost.

Oh well, it's only 120$. If it was $1200, it would be a different story. Just glad to have it over and done with. :p Accidents, even minor ones, suck.

Wow, she extorted 120$ out of you by ramming into your car where she was 100% at fault, then had you sign a legal disclaimer so that if you do realize you were robbed, you got hosed. You also basically signed off that it was your fault since the disclaimer makes no mention of what actually happened (worst idea ever), and she can dent your driving record if she choses to be a bitch. She owns your soul now.

She finds more idiots that sign and quiver at the sign of an attorney for her faults, and she'll be a millionaire.
