And personally, I want the notion of binding arbitration to die in a fire. But I also want the massive amounts of litigation for even the smallest of hangnails to die in a fire too. This is one of those hangnail situations.

I hate the NFL Contracts. Hopefully this is one domino closer to it falling.

Yes, and with this hangnail case is a clearer precedent. That's how rights are entrenched.

But, if you were Brady who felt he was unfairly persecuted, would you think it was a hangnail.

So I started reading Brady's actual complaint (we're all doing this, right? ;)). A number of the points made revolve around this:

If a given action will have punishment it has to be known before that action is taken. In context: if I don't turn over my phone I will be reprimanded.

Breaking a rule has to have a stated punishment. If I don't turn over my phone I will be suspended 4 games.

edit: These two points are at the heart of pretty much every fuck up by the NFL head office in the last couple years. These fall under "law of shop" rules which are basically aimed at overbearing employers from making up rules and punishment on a whim to ensure fairness in the workplace. Interesting.

From the ruling PDF, I cut the citing for ease of reading:

A "principal question for the reviewing court is whether the arbitrator's award draws its essence from the collective bargaining agreement, since the arbitrator is not free to merely dispense his own brand of industrial justice." "[A]s the proctor of the bar gain, the arbitrator's task is to effectuate the intent of the parties. His source of authority is the collective-bargaining agreement, and he must interpret and apply that agreement in accordance with the 'industrial common law of the shop' and the various needs and desires of the parties." It is the "law of the shop" to provide professional football players with advance notice of prohibited conduct and potential discipline.

That's a HUGE fuck you to the NFL. Every offense and punishment must now be spelled out.

so glad that it was overturned. this has been a COMPLETE non issue since the game they completely raped the colts. i can't believe it fucking took 8 months or whatever the fuck it was for it to be completely proven a non issue with absolutely 0 proof of any wrong doing.

i wish this would never be brought up again, but i know it's going to be discussed forever. the patriots haters are going to be in full effect now too.
