There seems to be a hard core belief of the majority in the SCOTUS that when Nixon resigned it was the worst thing that's happened to this country in it's history. I'm really trying to understand their ridiculous rationalization process.

The only watergate crime was the illegal disclosure of privileged presidential communications (per the Robert's Clown Court rulings)

For #3, that was also (along with conventional warfare) kind of the reason we came up with the idea of rules of war and war crimes. We realized collectively how bad it was getting and how much worse it would get so we as a species decided to try to avoid that in the future. Not everyone plays nice obviously.
