So it's up to the lower courts to determine what is an official act and what is an act as a private citizen? If Trump doesn't like how the court classifies his actions on Jan 6th, can he appeal that to the Supreme Court too?

Presumably if a judge seems inclined to declare something isn't an 'official act', the President can "officially act" to have that judge arrested or shot or something? Then keep going till he finds one prepared to declare all the previous actions official?

I don’t think these distinctions are relevant anymore as to me we are pretty clearly in a post law situation. It’s funny and sad to me to see people try and parse this decision and determine the best legal path forward when the decision itself basically throws the law out the window.

Don’t pardon YOU, pardon Harris after she carries out the coup!

The ruling said that Trump pressuring Pence to overthrow the government was official conduct that he is immune from prosecution for. Not sure why every president wouldn’t try a coup now.

Being honest I do believe many P&N posters are in jeopardy *if* the former President becomes President again.

I agree, they’ll start with the big hitters first, using people like Musk to “free speech” all the liberals. Eventually they’ll make it to the off beat places. More importantly, collaboration by people like pcgeek and imported hand grenedier will uncover places like this.

I'm from Australia, but I would like to offer my understanding and support for America undergoing a transition to a Monarchy.

Its not that bad.

A little extra pomp and ceremony here and there. A few more entries in the gossip mags. A slightly thicker skin on your forehead as you salute your betters. And a love of Corgi's ofcause.

They just played Biden's response on Australian TV. Sleepy Joe vs Emperor Trump... easy choice in the end. Trump might see it as a win now, but I think it will bite him at the election.
Americans are too ignorant to understand the ramifications.

Even though I have nothing for fascists beyond contempt and high capacity magazines, Canada and Ireland are always easy options for me.

Trump goes full on Franco and he'll have more pressing things to worry about than tech forum posters though. Being honest, I'd probably stay and make myself useful to the American cause.

I don't see a path out of this. I mean, how do you overturn a SCOTUS ruling?

You ignore it, like FDR threatened.

Or, in this case, you have to say "ok, i'm gonna use these new found powers that you've granted me (Biden) and embrace the Dark Brandon". Which won't happen, so we're probably fucked unless Trump somehow loses the election.

I still think Trump loses the election, but that doesn't mean everything goes back to normal. We can't keep Republicans out of the WH forever.

This the only long term fight is to flip the court by any means necessary and enact real reforms.
Pretend we flip the court. How do you go about reversing this decision? You'd have to tear up The Constitution and start over.

It's hard for me to see a path out of this that isn't pretty dark, I agree. As mentioned the real answer is most likely to ignore it.

Generally speaking I think that's Biden's best path forward in general now, to say that from this point forward he views SCOTUS opinions as advisory only.

You now have a court that follows the constitution, and it reverses the prior unconstitutional decisions as cases come up -- e.g. Trump's appeal that certain aspects of his conduct were official business, then the new Supreme Court can obliterate the prior decision.
