Texas Passes Merry Christmas Bill To Fight War On Christmas

Texas has passed a bill to allow teachers to say Merry Christmas and Happy Hanukkah along with displaying Christmas trees, nativity scenes and menorahs.

"Teachers have enough on their plate to worry about [whether] the school district's going to be sued or if they can call a Christmas tree a Christmas tree," said state Rep. Dwayne Bohac (R), who sponsored the legislation.


He told KTBC in Austin that he came up with the idea when his six-year-old son told him about how he had "decorated the holiday tree with holiday ornaments."

This is good news since school districts actually could be sued for calling a Christmas tree a Christmas tree. And this deals a blow to the secular progressives and others waging a War On Christmas.

You realize that this will do exactly zero to stop lawsuits against the state, right? Not only is this a ridiculous issue that is not worthy of spending any time on, but the prohibition of government endorsement of religion is federal, not state.

What this really is for is to indulge the persecution myth of a small percentage of stupid people.

It does not matter what federal law says, it is what the judge and jury says.

I'm sure this was their primary concern when concocting this bill. How many lawsuits would have been prevented in the past if this would been in place? How much money have they paid for such suits? Were there evidence that there was significant payment made due to such suits?

In short... are there facts to show prior loss from TX cases to support the financial case? I doubt a jury of Texans would ever grant such damage.

Nobody cares if Texas is a red or blue state, it's part of the United States and is subject to the Constitution.

Nothing in this act will prevent Texas schools from being sued and this law will offer no protection from loss.
 
Out of all the states, Texas probably practices Sharia law the most too

The people of the jury can disregard the law and vote their conscious. Its called jury nullification.

If your plan was to rely on jury nullification then this law was meaningless to begin with. You really haven't thought this through, have you?

Needless to say, your plan is a poor one as clearly there are enough losing cases about this sort of thing that stupid people in Texas thought it was necessary to write a law about saying Merry Christmas.

While I'm neither from Texas nor a lawyer, I'm going to guess that schools are using generic terms like "Seasons Greetings" and "Holiday Tree" for reasons of inclusiveness, not fear of a lawsuit.

And if your true intent is to free teachers and schools about backlash from parents and communities (or even lawsuits), then pass a law that allows mention and/or celebrating the full range of holidays, not just Judeo-Christian ones. A teacher should be able to wish her students a Happy Diwali, Wikkan Feast of Mabon, Buddha's Nirvana Day, or anything else that might be relevant to them. But that might expose our little precious ones to some belief system other than Christianity, and we can't have that now, can we?

If government recognition of Christmas is a violation of the Constitution it looks like we might have a problem...

If you truly support separation of church and state why are you not calling to eliminate Christmas as a federal holiday?
