When Michael David Dunns girlfriend asked him why he had just fired shots into a red Dodge Durango, killing 17-year-old Jordan Davis, Dunn told her he felt threatened by the four teenagers in the car and thought they were starting to advance on him.
But according to court documents released Tuesday by the State Attorneys Office, Dunn never told Rhonda Rouer that he saw any of the teenagers with a weapon. Dunn later told police he saw a shotgun in the Durango, and that is expected to be his main defense when he goes on trial for murder and attempted murder.
The couple, in town for Dunns sons wedding, said they didnt know anyone was hit until seeing it on TV the next day.
Jordan and his three friends were in the Durango on Nov. 23 when Dunn and Rouer pulled up next to them in a Volkswagen Jetta at a Southside gas station and convenience store. Rouer told police the music coming from the Durango was loud and Dunn said, I hate that thug music.
Rouer said it was common for Dunn, 46, to complain about thug music, but it was unusual for him to confront someone over it.
When Rouer went inside the store, Dunn asked the teenagers to turn down the music. The teen in the front seat complied. Davis, who was sitting in the right rear passenger seat, then told his friend to turn the music back up, the documents show.

The other teenagers said Davis and Dunn then began to have an argument while both were still in their vehicles, with Davis cursing at Dunn. A witness who had just walked out of the convenience store told police Dunn pointed a handgun out the window and said, You are not going to talk to me like that before he began firing at the Durango and continuing to fire as the vehicle attempted to leave the parking lot.
Police believe nine shots were fired, all by Dunn. Davis was killed, but the other three teenagers were not hurt.
Rouer didnt see what happened but heard the shots. Dunn shouted at her to get in the car and drove away at a high rate of speed.
She asked Dunn what happened as they were driving back to their hotel, and he never said anything about seeing a weapon. Once they got to the hotel, they didnt discuss it again.
The two left Jacksonville and returned to their home in Brevard County, where Dunn was located later in the day because witnesses reported his license plate number.
Dunn later told police he saw the barrel of a shotgun as Davis started to get out of the Durango. When detective M.A. Musser told Dunn that no gun was found in the vehicle or the surrounding area, Dunn said he saw either a barrel or a stick.
Dunn attorney Cory Strolla has argued that the teens drove away after the shooting, giving them a chance to dispose of a weapon.
But several witnesses, including a police officer making a nearby DUI arrest, said the vehicle left the parking lot but stopped about 400 feet away. After realizing Davis had been shot, the driver of the Durango drove in reverse back to the gas station, returning less than two minutes after leaving, police reports said.
None of the witnesses saw a gun or any other weapon in the Durango.
Strolla could not be reached for comment Tuesday. Attorney John Phillips, who is representing the Davis family in a civil lawsuit against Dunn, said Rouers statement shows Dunn has no credibility.
From the start this has been a credibility case, and each new piece of information that comes out shows that Michael Dunn cant be trusted, Phillips said.
Dunns next pretrial hearing is April 9 before Circuit Judge Suzanne Bass, who denied a request for bail last month.
A trial date has not been set.

Doesn't matter. He was in his occupied vehicle and there were verbal threats against his life with accompanying disparity of force. No weapon necessary to shoot at that point.
Unfortunately, it may have been that they were verbally threatening his life. Unless we have a witness that can back that claim up or Dunn can back the claim up of seeing a gun then the credibility of his testimony over the gun is going to remove any credibility about being verbally threatened.

And he's not lying about the gun, he is saying he saw a gun. Doesn't mean there was a gun, but he reasonably believed a weapon was being presented.
Not that a weapon was necessary for him to lawfully shoot. Get it?

And a gun isn't necessary for him to lawfully shoot. You know that. All he has to say is "I thought I saw a weapon". Doesn't mean a weapon has to be there, only that he believed one was present/showed along with the threats to his life and disparity of force.
