In this case, it would not be. Demanding a student to stand up would be demanding respect/allegience to the flag/anthem/pledge. With your reasoning, the 1940s supreme court case is meaningless as the teacher can just tell the student to stand and salute, and that's that.

Pffft I'd like to see a teacher get away with that in Australian schools, in my home town of Temora NSW Australia a teacher was murdered by a few police officers because their daughters made false claims of Harrasement(non sexual) against him, it was only one and half days after the claims where made that the teacher was found dead outside of town in a field hanging by his neck with his legs and arms tied. All because a few dumbass biatchs wanted some attention. teachers in this country have no power they are expected to take all the sh*t that students dish out.

According to the police report it was suicide, but everybody knew that the local police had done it, they just got transfers instead, the teacher was very popular, but these silly sluts figured they weren't going to take any "crap" from him and when he layed out the law to them, bam dead teacher, for the remainin two years that I was a Temora High school the teacher were sh*t scared to discipline students, I know I was one of the rougher students and could get away with almost anything, a few of my friend were caught smoking pot in th toilets and weren't even suspended because one of them had a copper for a father. as far as I'm concerned these dickheads in the thread title deserve everything they got, there is no respect in society these days, everybody has "rights", half the laws in my country don't even hold up in court when challaneged these days...the world is a *cked up place

Sounds a bit like a case of "suicide" in a prison here in Sweden.

It is completely inappropriate for a teacher to yell at a student, let alone pull a chair out from under him. When did it become ok for the teacher of america to disrespect a student and verbally assault him. This kind of behavior goes on far to often in todays society. The pledge and national anthem are not required nor are they in any way educational. It is an old practice that has nothing to do with todays life. Many of you may disagree with what I just said, that's ok. You do not have to agree with my opinion these rituals. Quite simply put, school is to teach the youth of america and give them the knowledge they need to grow and flourish in life. This is a very simple fundamental which is commonly lost. Teachers and students that just don't care are a sadly the precedent in schools. Learning institutions have become a prison with totalitarian rulers that over step the boundries given to them. Schools where set up to ensure the continued education of society. They are now a business that can not function and long ago would have run itself into the ground if not for the government and private donors fitting the bill. And if you don't think it affects you then just look at your taxes. The system is abysmal and everyday they go it just gets worse. Education, moral, self-worth, they are all at an all time low. People don't care anymore. I am homeschooling my little girl for just these reasons. It is not easy though, the state requires you to follow certain protocals. Every state is different, but it is far harder than it should be. Why is this, because the school loses money if your child doesn't attend. What's even better is that when you do have them take those stupid standardized tests, the school district you live in gets credit for the scores. How messed up is that. All this is after you actually go through the hassle of being able to teach your child. The system was setup to insure childern get taught and grow. Now it is about money and scores, who can brag the most about their students. If they can't, how can they make them better so that they can be paraded around as a testament to the greatness of their school. I could go on for much longer if need be but I think everyone grasps my point.

Yes, of any consequences that don't violate your rights. If the consequences result in another violating your rights, then there's problems. When the teacher used physical force, he crossed the line. Plain and simple. The teacher could've sent for a principal, aid, whatever. He should've never physically confronted the kid.

I believe you guys should be more pissed at the punks talking during the ceremonies and disrupting everything than the kid sitting there silently.

Also, just stating I do not agree with the kid's actions, but the teacher went overboard.

His actions and his friends looked pretty disruptive to me....

The kid's motivations are irrelevant. He cannot be legally compelled to stand. The teacher chose to punish the kid with brutality. The teacher should be reprimanded.
