So I got my first ticket today...what can I do about it?

I was dribing home after my first day skiing (awesome experience soured by this one event) and the place is about 180 miles away my house(Chicago). The speed limit is 55 on this stretch of one lane highway which suddenly changes into a town street with a speed limit of 30 mph. I started slowing down at that point and slowed to less than 45 even before passing the first sign. Into town, I'm going about 33 mph (i kept looking at the speedometer) just a couple of miles over the speed limit. The town only lasted about 5 blocks and just as I was about to leave town I see this headlighte speeding at me so I firgured I better hurry up as I was already passed by 2 cars speeding like crazy earlier. I already see the 55mph sign (though I'm not there yet) but at that point I'm still only at about 45 and speeding up when the car behind me pulls on their sirens.

The cop claimed I was going 53 in the 30mph zone. I responded by saying I only started speeding up when I saw highlights behind me gaining on me and that the town had just ended already. He takes my information and heads back to his car. He comes back after like 5 minutes and says "I'm not taking your license right now and you don't have to pay anything right now, I'm just going to give you a citation and you'll only have to send in the $95." I was nodding alone thinking he was going to let me slide as the only time I could have been considered speeding where under reasonable circumstances but that last statement caught me by suprise so I was like ok.

In any case, at that point I tried explaining again that I had only speeded up when I saw headlights gaining quite fast on me and that I had already left town where I could already see the new speed limit again. He responds by saying he clocked me in the middle of town going 53mph. I didn't know what to say at that point as he just handed me my ticket and told me to sign. He then says again "just mail this in along with a check or soemthing for $95. You don't have to go to court and you can attend traffic school to get it off your record". Anyways, it was until he left my car that I could clear everything up in my head. I know for a fact I never topped 45mph since I kept a constant lookoout on my speedometer. And since the speeding ticket was for 53 in a 30 zone (more than 20mph over the limit) the ticket was $95 instead of $75 I think.

What sucks is I can't take it to court as I'd have to travel 180 miles to and another 180 miles back!! On top of that I can't attend raffic school either because of that same reason!! I had another passenger who I was with who knew exactly how fast I was traveling because when I first saw the 30mph sign I asked what it was and started slowing down! I seriously think that cop didn't really care about anything but giving a ticket. What can I do to fight this as I really can't afford the $95 ticket and having this on my record. I'm 20 and insurance is going to be a killer plus school is starting so I can't go on the appointed court date a month away. Is there anyway to fight this and in the very least not get this on my record without traveling almost 400 miles round trip by car???

This totally soured a great day!! $95 for a college student is killer.

You can take the classes online most of the time..

Just pay the ticket, it's too much work to do anything else.

If you're really that tight on money it might be worth it to get it off your record, might save you insurance in the long run. You should really just get a job though...$95 shouldn't be a big deal.

Accept it. If his radar said 53, in all likelihood you were going 53. If you're sure you were going slower, perhaps your speedometer is off.

23mph over is a 4 point ticket right? i thought that ticket was more like $200, but maybe that is just here in NJ. but the points is the killer. u can go to court and get it reduced to 2 points (then take a defensive driving course from dmv and remove the other 2 points). if u get lucky, the prosecutor could take them all off, but i dont think that happens often. having a lawyer should ensure that the 4 points will get taken off, tho it is never guaranteed. i think u should just go to court and plea bargain... u'll at least get 2 points off. u could ask to get all 4 off, since it is u first ticket. if he doesn't... take the 2 points... and do the defensive driving class thing. that will get rid of all points. u will still pay for the speeding ticket, court fees, fee for the driving class, and the dmv surcharges.

by the way... from what i understand... the lawyer will be about $300.

In any case, I know for a fact I wasn't going 53 in the middle of town where the cop claimed. I might have gone up to that speed where I was actually pulled over but at that point the speed limit was already 55.
So I bet cops tell the truth all the time eh? In the middle of town I hit 1 stop sign and 1 red light in a 6 block distance. I'm sorry but my car isn't really that fast for me to speed up to 53 without flooring it.

And to you Happypuppy, you must really be a sad pathetic person to go around putting people down in order to prop yourself up. My helpful advice in this case would be to go get some friends, that should help.

in court... it's pretty much ur word against his, so the odds r stacked against u. the point now is... u r gonna have to pay. the question is... how much.

By your own admission you were atleast 15 over the speed limit, 45 in a 30. You were speeding, got busted. Pay the ticket and be done with it.

Who's to say he didn't clock me as I was exiting town when my speedometer read about 45 and rising? Like I said, there were 2 times I had to stop within town so speeding up to 53 mph with my 112 hp car wouldn't really be smart to do only to stop again a couple of blocks away.

So you want me to decide who has more credence, a law enforcement professional or a guy who complains about a speeding ticket on a tech-related message board? I'm sorry, but I'm going with the officer. Perhaps he did clock you later than you claim he said, but as long as you were still in the 30mph zone it's speeding. Deal with it.

You're probably out of luck. Your best bet is to find out how your state handles tickets if you please no contest or something like that - you'll have to go bcak to go to court, but if it is your first ticket and you're polite about it etc usually they will let you off with a fine and the points won't go on your record. Altenrately start calling around for a ticket lawyer, which here in FL will also cost you about a hundred bucks.

No matter which way you slice it you'll be out a hundred bucks, but keeping the points off your license is probably pretty important.. paying the ticket outright *guarantees* the points go on, all of the other options leave you some hope.

Yes but as you should know, if you didnt already, the speed limit is still 30mph until you pass that 55mph sign.

Ok, again I don't really care if you believe me or not. If you really think that cops and people in authority are always right, then you have problems. Since President Bush is the highest ranking person in the US, then no one can question him or his actions? Of course his motives are in the best interest of everyone right?

I'm just saying there are grey areas of speeding. Does seeing the 55mph sign mean it's a 55 zone or do you have to pass the sign in order to go over 30?

I can't wait for karma to come around on some of you.

There is no grey area. You get clocked higher than the posted limit, you're speeding.

And yes, you have to pass the sign. I thought everyone knew that.

if u can't go to court, then u can't fight it. some ppl say that if u have a lawyer, they can represent u in court in place of u... i don't know if that is true. but since u can't afford a $95 ticket, i don't think u can afford a $300 lawyer. so let's look at this realistically...

1.) u can't travel 180 miles to fight it in court.
2.) u can't afford a $95 ticket; therefore u can't afford a $300 ticket

so u can't afford to be there... and at the same time u can't afford to not be there either. dude... we are not miracal workers. you already admitted to speeding (doesn't matter whether u were doing 43 or 53). even if it were only 43... u said u can't go to court right? r u just bitching for the sake of bitching? yes there are a lot of dicks on the forums, but i think a lot of ppl have already gave u some realistic and good advice. also, if u do a search, u will find a plethora of threads about speeding that will have probably everything u need to know. stop complaining, and start figuring out how u r gonna raise some cash for ticket which u r guilty of. yes it sounds harsh, but u will not get off the hook as easily as saying "i'm sorry". whether u can afford it or not... u owe whatever township some cash.
