Yea, because lieing in court when there is an officer as a witness is an incredibly intelligent thing to do.

Look people, laws like this one and double fines in workzones are being implimented because the majority of people out there are stupid and putting in danger the public servants and construction workers that are out there to keep our highways safe. Obey the law and stop bitching if you get a ticket for putting someones life in danger.

did he say there wasn't a car next to him? did the cop tell him that there was no car next to him? how the fck should i know, if they didn't then seems fair game to me

Go to court and tell the judge that there was traffic in the other lane... that you slowed down, but you could not safely move over without hitting the brakes hard and possibly causing an accident.


hopefully the cop wont even show up to court and you will skate... failing that... since you could not safely move over, see if you ca bargain to pay the ticket but no points.

I always move over when I can as a courtesy. I had no idea there were laws about it though.

I wish they had one here in NJ. I have lost count of a$$holes on Route 1 and the Garden State Parkway that will speed by an accident when an ambulance is there trying to treat passengers involved in an accident. Most of the jerks just drive right on by in the lane at 70 mph+, while I'm trying to stabilize somebody's neck.

Nope, he didn't say, and without knowing you advised that he should tell them there was without even knowing. The only assumption that can be made is that you told him to lie. In fact these laws (at least everyone that I have read) have exemptions for not being able to move over (usually requiring the driver to slow down) and the officer wouldn't have even cited him for it. In fact given the officers attitude the OP didn't even try to move over or slow down and may have come within inches of hitting the officer.

This isn't a game, understand this, this law makes it possible for them to prosecute you for manslaugter for failing to yield.

how the fck can you say the only assumption made here is to tell him to lie. if the point hasn't been made it can go either way. as far as the cops attitude, once again you have no idea about his motivations...his wife could have left him, his dog could have been shot, it coudl have been the OP..any of those reasons could have gotten him the ticket. and to think that there aren't cops out there on powertrips just wanting to give out tickets for no reason is naive.

Because you didn't know the situation and you advised to say there was a car next to him and that the officer couldn't prove otherwise (Other than the officer was a witness to the incident). That can ONLY mean you intended him to lie. Your attempt to claim you weren't advising him to lie is almost as pathetic as advising him to lie.

And the officer could have been nearly killed and he could have recently attended the funeral of one of his fellow officers hit by some inconsiderate irresponsible a$shole.

As I said, be glad it's only a ticket, this law makes it possible for them to put you in prison for hitting a cop on the side of the road even if it wasn't intentional.

mabye if you weren't sitting in the left lane like a smacktard, this wouldn't have happened.... ALWAYS get out of the way of vehicles closing on you when there's nobody in front of or to the side of you... if the next lane to the right is blocked, get over as soon as it's safe.

The cop was closing on you. You didn't get out of the way when you should have. You loose.

People who do what you did are more dangerous than speeders.

1) It's basic traffic curtosey
2) They taught it in drivers ed
3) It's the law

And I assume he climbs out of his passenger door to come talk to you? Or maybe he just teleports over there, right?

Maybe you should get out and walk along a freeway sometime, there is this thing called air, and it tends to build up in a cone shaped barrier around a fast moving vehicle. Larger vehicles create bigger cones of this thing called air and when it's moving at nearly the same speed as the car the vortecies that form behind this cone of air can do things like suck a fully sized human being out into the travel lane. In addition people tend to do stupid things while driving like glance down at their radio or pick up objects and in that half a second that they aren't looking the car travels in excess of 44ft (at 65mph) and in that instant a slight deviation in bearing will result in a side motion of up to a few feet and that officer getting in and out of his car or walking up to your can be killed by that person that stopped paying attention for just a half a second.

At less than 40K a year these public servant should be able to stop vehicles without threat of being killed and leaving their familes to fend for themselves.

Our readers have informed us that "move over" laws are also on the books in Georgia, Florida, Illinois, Indiana, Iowa, Kansas, Maine, Michigan, Minnesota, Missouri, Nevada, North Carolina, Ohio, Oregon, South Dakota, Tennessee, Utah, Virginia, Wisconsin, Wyoming, Ontario, and Saskatchewan.

Well, Pennsylvania isn't listed, which is probably a good thing as I've never heard of it.

Edit: It's been law in Florida for three years. "The "Move Over Act", passed during the 2002 session of the Florida Legislature, was signed by Governor Jeb Bush on May 1, 2002."

It won't matter if you say a car was beside you if he clocked you as you are supposed to slow 20MPH below the posted speed limit.
