All I know is that there should be a special new rule enacted that forbids a sitting President from carrying out a constitutional duty of appointing a supreme court justice. Not because that President is black, or liberal, or because it's during ElectionYear™.

It should be a new rule because I don't want a libruul justice replacing a conservative justice.

Because freedom.

Also: Benghazi.

I'm going to laugh if the GOP gets their wish, and then President Clinton nominates Obama.

He would likely be a better nominee from the GOP perspective than anyone he is likely to nominate if he gets his way. Actually being President will give him better perspective and hopefully judgement than someone from academia or in the judicial branch their entire career.

Well, his degree is in constitutional law to begin with isn't it.

But I hardly think that one would ever get any traction, as the GOP has more or less been calling him a liar ever since he was elected and have been spitting in his face more or less for 8 years now.

With a specialization on the supreme court. Hes exactly the person we want to have select a new judge. Obama is pretty tame when it comes to being a progressive. Disappointingly so.

One more wise Latina (aka racist) and you'll have the right to be armed when and only when government arms you to serve it.

RIP Scalia. Hello election circus squared.

Slime and baseless fear mongering in the same sentence. You've outdone yourself.

How long do we have to wait before it's appropriate to say that Scalia's death is a wonderful thing for America? Is it 40 days?

In our household it was yesterday. I think you can respect his humanity and feel for his family, and at the same time recognize that he was a horrific jurist, and the country will be much better off once his seat is filled.

OK then.
Scalia Family: My condolences.
America: My congratulations.

You mean in a well regulated militia, providing for the security of (not from, as right wingers seem to think) a free state?

I kinda like the idea of nominating Eric Holder just to watch their heads explode as they shit themselves...

Not likely, I'm sure.

It's a mistake, I think, for Repubs to make this about Obama because it opens up incalculable possibilities. It can easily blow up in their faces but they're apparently not skeered when they should be.

There should be a term limit on future Justices. It is a solution that is not partisan, and is not disrespectful to the court.

I agree. 20 year terms. When the Constitution was written, average life expectancy was 35 years, so they didn't need term limits then.

How can that even matter when Repubs vow not to fill a vacancy because of the man making the nomination rather than the qualifications of the nominee?

I would pay good money to have front row seats to the shit show that would ensue if that happened.

Exactly, not to mention that he will likely pick someone even more moderate just to put the Republicans in a political hard spot. As far as a Supreme Court Justice being nominated by a Democrat this is the most moderate person they are going to get a chance at.
