The standard for rape should be short of fighting to the death, but at least to the point of an extended hospital stay.

It would be ridiculous to say that only a dead woman could be raped, because if she didn't fight to the death, she must have wanted it. But somebody just "letting" it happen could not have been raped, which is why a 3 day stay in the hospital for injuries is probably a good rule of thumb.

If a guy was raping me in the ass, I'd probably end up dead, or he would. Not everybody has my conviction towards keeping my asshole free of dick, which is why I'd be willing to grant leniency in their defense of ass, and say a 3 day stay in the hospital is de facto proof of rape. Anything short of that, and a little part of you wanted that dick in your ass.

In honor of this thread I tried an experiment with my GF yesterday.

I went out to mow the grass, and came in dirty and full of grass. So I went up to my bedroom because I was going to take a shower. She was there pulling clothes out of the laundry basket. I stripped down naked and hopped into bed and pulled the covers over me. She was like "Why did you jump into bed naked? Are you horny?" I said "No..."

The problem with your argument is that whether or not consent is given is to a large extent dependent on the perceptions of the people involved.

Rape is supposed to be a serious crime nearly on par with murder. How in the world could 73% of supposed victims not realize they were the victim of such a serious crime?
