One problem I don't have to worry about havnt dated in 21 years. But in my day no meant no. Bet it still does.

Enlighten me as to what I don't understand about rape.

1: The determination of consent. How it is supposed to be granted or denied?

2: How any third party not present is supposed to figure it out and adjudicate the matter.

I'm not a lawyer but:

1) Optimally, consent would be determined verbally and actively. (Difficult in one's hormone-raging teen years and even sometimes in adulthood).

2) Very difficult. For the most part I think more weight is given to the victim.
